3. Findings of Fact:
In reviewing the request for Morningside Villas Subdivision, Staff makes the following
findings of fact:
A. The request conforms to the applicable Plat Standards of the Land Use Code.
B. The request conforms to the standards of the R-L zone district.
FINDINGS AND CONCLUSIONS
After reviewing the staff report and the record of the public hearing, the Hearing Officer
makes the following findings and conclusions:
A. The Replat of Lot 3, Scarpella Subdivision is subject to administrative review and
the requirements of the Land Use Code (LUC).
B. The Replat of Lot 3, Scarpella Subdivision conforms to standards of the R-L
zoning district.
C. The Replat of Lot 3, Scarpella Subdivision conforms to the applicable plat
standards as put forth in the Land Use Code.
D. Future development of the property will be required to meet Land Use Code
Division 2.6 DEVELOPMENT CONSTRUCTION PERMITS; and, Division 2.7
BUILDING PERMITS.
DECISION
Based on the findings and conclusions, the request for the Replat of Lot 3, Scarpella
Subdivision is approved.

2.1 of the Land Use Code.

COMMENTS:
1. Background:
The surrounding zoning and land uses are as follows:
N: R-L; Existing Residential
S: R-L; Bauder Elementary School
E: R-L; Existing Residential
W:R-L; Existing Residential
The original Scarpella Subdivision was platted in 1977 as a three -lot subdivision. Lot
Three contains an existing single family dwelling that fronts on Prospect Road.
2. Plat Standards
The plat has been reviewed against the criteria of the Plat Standards under Article
Three, Division Three of the Land Use Code. The request to replat Lot Three in order
to create two new lots of 13, 928 and 7,555 square feet complies with the following
standards:
A. Section 3.3.1 (B) (2) - Lots
The two new lots comply with the minimum lot area requirement of 6,000 square feet in
the R-L, Low Density Residential zone district. Both lots exceed the required minimum
of 50 feet of street frontage. Lot One has 100 feet of frontage along Prospect and Lot
Two has 106 feet of frontage along Evergreen Drive. Both streets are dedicated public
streets.
B. Section 3.3.1 (B) (2) - Lots
Both new lots front on existing streets that interconnect with the larger neighborhood via
Prospect Road and Evergreen Drive.
C. Section 3.3.1 [C] (1) - Public Sites, Reservations, and Dedications
The plat indicates proper dedications for drainage and utility easements as needed to
serve both lots.

NOTICE OF PUBLIC HEARING: Notice of public hearing was made on November 17,
2000 by mailing to property owners within 500 feet of
the subject property.
The public hearing was advertised in the Coloradoan.
PUBLIC HEARING
After reviewing the Staff Report and recommendation, a public hearing was held on the
subject application at 3:00 PM on December 1, 2000. The hearing was held in
Conference Room D at 281 North College, Fort Collins, Colorado.

This is a request for a subdivision in order to divide one lot into two parcels. The
original Lot 3 of the Scarpella Subdivision contains 21,482 square feet. The request
would create two lots with one being 13,928 square feet and the other lot containing
7,554 square feet. The purpose is to place the existing single family dwelling on the
larger lot and create a new legal building lot for one new residential structure. The
existing structure is addressed as 2400 West Prospect Road. The parcel is zoned R-L,
Low Density Residential which allows a new single family dwelling as a permitted use.
