D. Future development of the property will be required to meet Land Use Code
Division 2.6 DEVELOPMENT CONSTRUCTION PERMITS; and, Division 2.7
BUILDING PERMITS.
DECISION
Based on the findings and conclusions, the request for the Morningside Villas
Subdivision is approved.
Dated this 14th day of September 2000, per authority granted by Sections 1.4.9(E) and
2.1 of the Land Use Code.

A. Section 3.3.1 (B) (1) - Lots
There is no required minimum lot size in the L-M-N zone district. The lot has 50 feet of
frontage along Morningside Drive, a dedicated public street.
B. Section 3.3.1 (B) (2) - Lots
The subdivision fronts on an existing street that interconnects with the larger
neighborhood via Parker Street and Stover Street.
C. Section 3.3.1 [C] (1) - Public Sites, Reservations, and Dedications
The plat indicates proper dedications for drainage and utility easements as needed to
serve the lot.
3. Findings of Fact:
In reviewing the request for Morningside Villas Subdivision, Staff makes the following
findings of fact:
A. The request conforms to the applicable Plat Standards of the Land Use Code.
B. The request conforms to the standards of the L-M-N zone district.
FINDINGS AND CONCLUSIONS
After reviewing the staff report and the record of the public hearing, the Hearing Officer
makes the following findings and conclusions:
A. The Morningside Villas Subdivision is subject to administrative review and the
requirements of the Land Use Code (LUC).
B. The Morningside Villas Subdivision conforms to standards of the L-M-N zoning
district.
C. Morningside Villas Subdivision conforms to the applicable plat standards as put
forth in the Land Use Code.

1) Will topography on the site cause future flooding?
2) How will access be provided to the site?
Brett Larimer indicated that the property slopes toward Spring Creek, away from
Ms. Parkins property, and that site engineering has been completed that
confirms compliance with City stormwater requirements.
Brett Larimer pointed out on the subdivision plat that access is taken directly
from Morningside Drive.
COMMENTS:
Background:
The surrounding zoning and land uses are as follows:
N: L-M-N; Existing Residential
S: L-M-N; City of Fort Collins Drainage Property and Spring Creek
E: L-M-N; Existing Residential
W:L-M-N; Existing Residential
The parcel is a remnant that remained after City acquisition of a larger property for the
purposes of constructing drainage improvements and flood protection measures along
Spring Creek. This was a major capital project that involved moving structures,
constructing two new bridges and channel widening of Spring Creek.
2. Plat Standards
The plat has been reviewed against the criteria of the Plat Standards under Article
Three, Division Three of the Land Use Code. The request to plat one 11,900 square
foot lot complies with the following standards:

NOTICE OF PUBLIC HEARING: Notice of public hearing was made on August 29,
2000 by mailing to property owners within 500 feet of
the subject property.
The public hearing was advertised in the Coloradoan.
PUBLIC HEARING
After reviewing the Staff Report and recommendation, a public hearing was held on the
subject application at 4:00 PM on September 6, 2000. The hearing was held in
Conference Room C at 281 North College, Fort Collins, Colorado.

PROJECT DESCRIPTION:
This is a request for a subdivision in order to plat one lot containing 11, 900 square feet.
The purpose is to create a legal building lot for one five-plex residential structure. The
parcel is located at the south end of Morningside Drive, on the north bank of Spring
Creek, between Stuart and Stover Streets. The parcel is zoned L-M-N, Low Density
Mixed -Use Neighborhood which allows a five-plex as a permitted use.
