The parcel is a remnant that remained after City acquisition of a larger property for the purposes
of constructing drainage improvements and flood protection measures along Spring Creek. This
was a major capital project that involved moving structures, constructing two new bridges and
channel widening of Spring Creek.
2. Plat Standards
The plat has been reviewed against the criteria of the Plat Standards under Article Three,
Division Three of the Land Use Code. The request to plat one 11,900 square foot lot complies
with the following standards:
A. Section 3.3.1 (B) (1) - "Lots"
There is no required minimum lot size in the L-M-N zone district. The lot has 50 feet of frontage
along Momingside Drive, a dedicated public street.
B. Section 3.3.1 (B) (2) - "Lots"
The subdivsion fronts on an existing street that interconnects with the larger neighborhood via
Parker Street and Stover Street.
C. Section 3.3.1 [C] (1) - "Public Sites, Reservations, and Dedications"
The plat indicates proper dedications for drainage and utility easements as needed to serve the
lot.
3. Findings of Fact:
In reviewing the request for Momingside Villas Subdivision, Staff makes the following findings
of fact:
A. The request conforms to the applicable Plat Standards of the Land Use Code.
B. The request conforms to the standards of the L-M-N zone district.
RECOMMENDATION:
Staff recommends approval of Morningside Villas Subdivision, #23-00

PROJECT DESCRIPTION:
This is a request for a subdivision in order to plat one lot containing 11,900 square feet. The
purpose is to create a legal building lot for one five-plex residential structure. The parcel is
located at the south end of Morningside Drive, on the north bank of Spring Creek, between Stuart
and Stover Streets. The parcel is zoned L-M-N, Low Density Mixed -Use Neighborhood which
allows a five-plex as a permitted use.
