As you can see, the City and the B.N.S.F. have long shared a historic partnership and that numerous right-of-way parcels have annexed into the City. This partnership has flourished over that last 129 years and we look forward to future growth and cooperation. It is our hope that you will consider annexation of the abutting portion of the Arbor South First Annexation favorably. I have taken the liberty to enclose a City of Fort Collins Annexation Petition. By signing the petition, as an agent of B.N.S.F., consent is granted for the Annexation. There would be no cost to B.N.S.F. as all administrative efforts would be borne by the City. Other than signing the Petition, an attorney would have to certify that B.N.S.F. is indeed the owner of the subject property. The railroad parcel is 4.824 acres in size and shown in yellow highlight on the enclosed annexation plat titled "Arbor South First Annexation." The legal description is attached. This legal description was prepared by a Colorado Professional Licensed Surveyor and is considered accurate and sufficient as an attachment to the Annexation Petition. On June 19, 2001, the City Council approved an Annexation Petition from Mr. Paul Hefron known as the Arbor South First Annexation. This annexation consists of 11.25 acres and abuts B.N.S.F. right-of-way. Please refer to the attached map and Annexation Plat. This parcel abuts the B.N.S.F. right-of-way. We are very interested in pursuing the annexation of the abutting portion of B.N.S.F. right-of-way. The purpose of this request is to implement a very exciting transportation project known as the Mason Street Transportation Corridor Master Plan. For your information, I have also enclosed a copy of this planning document. The Mason Street project is specifically designed to enhance north -south mobility to connect neighborhoods to the Colorado State University campus and downtown. As the project moves forward, the City will be approaching B.N.S.F. about possible scenarios for construction of public improvements. We remain challenged in our implementation, however, if such improvements are not within our municipal boundary. We look forward to future discussion with you regarding the mutual benefits between B.N.S.F. and the City of Fort Collins on the implementation of this Plan. A previous contact with Staubach Management indicated a reluctance to agree to annexation. I would like to address your reluctance by noting that the B.N.S.F.
