Since the Arbor South Property direct abuts B.N.S.F. right-of-way, it becomes part of the
"community of interest" to annex this right-of-way. This is consistent with railroad right-
of-way from Harmony Road on the south to the Larimer and Weld Canal on the north.
Therefore, in order to implement our vision as stated in the Mason Street Transportation
Corridor Master Plan, and in conjunction with the Intergovernmental Agreement, the
City desires to annex a portion of the B.N.S.F. railroad right-of-way. Indeed, I think you
would agree that our City would be difficult to administer if the B.N.S.F. railroad right-
of-way, which runs the entire north -south length of the City, were to not be included
within the corporate municipal boundaries.

This letter is in response to your request for information regarding City's interest in
annexing railroad right-of-way. As you are aware, the City has requested that a portion
of the Burlington Northern Santa Fe railroad right-of-way be included in the Arbor South
Property Annexation petition.
It has long been the custom and practice to annex railroad right-of-way into the City of
Fort Collins. Colorado State Statutes allow municipalities to annex properties that are
contiguous to city limits and where a "community of interest" exists. As the City of Fort
Collins has grown over the years, railroad properties have been annexed roughly in
proportion to the timing and sequence of the general pattern of growth of the City.
The property in question, Arbor South Property, is within the City of Fort Collins Urban
Growth Area. Based on an Intergovernmental Agreement between the City of Fort
Collins and Larimer County, parcels that are contiguous to the city limits and eligible for
annexation shall be annexed. The purpose is that the City is better equipped to provide
an urban level of services than the County.
Arbor South Property is also contained within the area known as the Mason Street
Transportation Corridor and subject to the Mason Street Transportation Corridor
Master Plan. This is a transportation corridor intended to enhance opportunities for
pedestrians, bicyclists, and transit riders along its length, to encourage development, and
to provide for economic opportunities. 'It will provide a direct north/south route for
bicyclists and a faster passenger -trip time using transit technologies rather than having to
use autos on a congested College Avenue.
The Mason Street Corridor, which includes College Avenue, is extremely vital to the
City as a place of employment and destination for shopping, entertainment, and services.
As growth continues, the Mason Street Transportation Corridor will provide parallel
transportation opportunities to College Avenue which is critical to the vitality of the
Corridor and the City.
