The purpose of next Wednesday's LPC meeting will be to hold a public hearing on the relocation of the
Historic Gasoline station. This is required under Chapter 14 (Landmark Preservation), Section IV of the
code, "Demolition or Relocation of Historic Buildings and Sites not Designated as Local Landmarks or
Located in a Landmark District". The service station and the garage have been deemed "eligible" for local
landmark designation, and thus before they can be moved they must go through this process. In this
situation, the city is purchasing property for ROW; the ROW they need includes the service station; hence,
the gasoline service building is to be relocated. It is my understanding that the Streets folks are going to
temporarily relocate the service station to some nearby publicly owned land; a future decision then needs
to be made as to its final disposition.
The Board is acting in its "quasi-judicial" authority. However, its authority is limited in what they can
decide. At the meeting they can decide to postpone their decision for up to 45 days; or, they can approve
the request. Within the 45 days, however, they still must approve the application. They can also decide to
consider landmark designation (in this case it would be non -voluntary on the part of the applicant - the
LPC won't do this) . They can also require the property owner to provide photographic documentation of
the building or allow the access to take photographs (the City street folks have already agreed to photo
document the building as soon as they secure ownership of the building).

Greg Byrne wanted me to ask about the action that the LPC will take regarding the Harmony Store. Is
their meeting a public meeting or a public hearing. Are they taking a quasi-judicial action or making a
recommendation. These questions came up at this morning's City Council agenda review meeting
