Dear Vicky:
The purpose of this letter is to clarify the City's enforcement activity on a landscaping
and pavement improvement easement that was granted to the City of Fort Collins by Mr.
Rose in conjunction with the old carwash development at 121 East Swallow Road being
the southwest corner of East Swallow Drive and Remington Street. Obviously, the
carwash development was demolished and replaced by the Swallow Off ice Building
Project Development Plan, Current Planning file #45-00. The legal description is Lot 2,
Block 3, Thunderbird Estates Ninth Subdivision.
The City of Fort Collins would not take any enforcement activity on this old easement.
The new Swallow Office Building P.D.P. supercedes the old carwash development. This
determination is based on Section 2.2.11(D)(7) of the Land Use Code which states:
(7) Planning over old plans. In the event that a new final plan is approved for a
parcel of property which includes all of a previously approved site specific
development plan, the approval of such new final plan shall cause the automatic
expiration of such previously approved site specific development plan. In the
event that a new final plan is approved for a parcel of property which includes
only a portion of a previously approved site specific development plan, the
approval of such new final plan shall be deemed to constitute the abandonment of
such portion of the previously approved plan as is covered by such new plan, and
shall be reviewed according to the abandonment criteria contained in Section
2.1.4(C) and all other applicable criteria of this Land Use Code.
