FINDINGS OF FACT/CONCLUSION:
1. The area meets all criteria included in Colorado Revised Statutes to qualify for a
voluntary annexation to the City of Fort Collins.
2. The annexation of this area is consistent with the policies and agreements between
Larimer County and the City of Fort Collins as contained in the Intergovernmental
Agreement for the Fort Collins Urban Growth Area.
3. The annexation request complies with all applicable Land Use Code criteria.
4. The requested Low -Density Mixed -Use Neighborhood (LMN) zone district is in
conformance with the policies of City Plan and is consistent with the Structure Plan.
RECOMMENDATION:
Staff recommends approval of the annexation and recommends that the property be
placed in the Low -Density Mixed -Use Neighborhood District (LMN).

open space, trails or parklands. The proposed annexation is within the Fossil Creek
Reservoir Area planning area. The portion owned by the City of Fort Collins is intended to
be used as parkland, so the foregoing limitation does not apply. The County has
requested that the City consider annexation of the portion owned by the Poudre School
District, so the foregoing limitation also does not apply.

In the IGA, the city agrees to annex all rights -of -way, easements, etc. adjacent to a
voluntary annexation. The proposed an'nexation includes the adjacent applicable portion
of Ziegler Road.
4. Land Use Code Criteria for Annexations:
[Section 2.12] — The Planning and Zoning Board shall hold a hearing on the matter of
annexations and report recommendations to City Council. Such Report shall include a
recommendation on the proper zoning for the lands if the City Council annexes such lands
into the city. The requested zoning for this annexation is the Low Density Mixed -Use
Neighborhood (LMN) zone district.
[Section 2.9.4(H)] — Any amendment to the Zoning Map involving the zoning or rezoning of
six -hundred forty (640) acres of land or less shall be recommended for approval by the
City Council only if the proposed amendment is consistent with the City's Comprehensive
Plan or warranted by changed conditions surrounding the subject property. The City's
adopted Structure Plan, a part of City Plan, designates the site as Low -Density Mixed -Use
Residential with a swath of Rural/Open Lands and Stream Corridors along the McClelland
Channel, which goes diagonally through the property. Such stream corridors are not
typically reflected in the zoning, so a zoning designation of LMN is consistent with the
Structure Plan designation.
5. City Council Hearings:
City Council hearings on this proposed annexation and zoning will be held on the following
dates:

COMMENTS:
1. Background:
The surrounding zoning and land uses as follows:
N: LMN — Kechter Road, Willow Brook PDP (currently under review),
S: FA 1 Farming (Larimer County Zoning) — existing agricultural, Staley PD (proposed
low density residential under review with Larimer County), Fossil Lake PUD Swift
Addition (approved low density mixed=use residential),
SW: FA 1 Farming (Larimer County Zoning) — Fossil Lake P.U.D. 15t filing (under
construction),
E: FA 1 Farming (Larimer County2oning) — existing agricultural, Staley PD (proposed
low density residential under review with Larimer County),
W: FA 1 Farming (Larimer County Zoning) — Fossil Lake P.U.D. 2"d filing (approved low
density mixed -use residential).
The portion of the proposed annexation owned by the City of Fort Collins is scheduled to
become a neighborhood public park. Parks of this scale typically are zoned the same as
the surrounding neighborhood. The portion of the proposed annexation owned by the
Poudre School District is scheduled to become a new elementary school.
2. Colorado Revised Statutes:
This property is eligible for annexation according to CRS, requiring 1/6 contiguity to the
existing city limits. The Staley First Annexation and Zoning complies with this standard
since the property has 1,039.04 feet of its total boundary of approximately 4230.32 feet
contiguous to the existing City limits. This meets the minimum 705.05 feet required to
achieve 1/6 contiguity. This contiguity occurs through a common boundary with the Willow
Brook Annexation (September 1999).
3. The Intergovernmental Aqreement Between Fort Collins and Larimer County:
The property is located within the Fort Collins Urban Growth Area (UGA). According to
policies and agreements between the City of Fort Collins and Larimer County contained in
the Intergovernmental Agreement for the Fort Collins Urban Growth Area, the City will
agree to consider annexation of property in the UGA when the property is eligible for
voluntary annexation according to state law.
In the IGA, the City agrees not to annex property within the portion of the Fossil Creek
Reservoir Area planning area which. is located east of County Road 11 (Timberline Road)
and south of County Road 36 (Kechter Road) unless the County either requires the
landowner to petition for annexation, or requests that the City consider annexation, except
the forgoing limitation on annexation shall not apply to the annexation of publicly owned

OWNERS: City of Fort Collins & Poudre School District
PROJECT DESCRIPTION: This is a request for a 100% voluntary annexation. The site is
approximately 24.5 acres of property owned by the City of Fort Collins and the Poudre
School District. It is located south of Kechter Road (County Road 36), north of the Fossil
Creek Reservoir, east of Ziegler Road (County Road 9), and west of Strauss Cabin Road
(County Road 7). The recommended zoning is Low Density Mixed Use Neighborhood
(LMN).
EXECUTIVE SUMMARY: The Staley Annexation and Zoning is in substantial compliance
with the Colorado Revised Statutes, the Intergovernmental Agreement between Fort
Collins and Larimer County, and the Fort Collins Land Use Code.
