FINDINGS AND CONCLUSIONS
After reviewing the staff report and the record of the public hearing, the Hearing Officer
makes the following findings and conclusions:
A. The Summitview Pump Station Project Development Plan is subject to
administrative review and the requirements of the Land Use Code (LUC).
B. The Summitview Pump Station Project Development Plan conforms to standards
of the LMN zoning district.
C. The Summitview Pump Station Project Development Plan complies with all
applicable General Development Standards contained in Article 3 of the Land
Use Code.
D. The P.D.P. satisfies the applicable criterion relating to the "local street portion" of
the Timberline Road street improvements by escrowing an amount acceptable to
the Director of Engineering. This escrow will cover the cost of the applicant's
share of the roadway improvements at no risk to the traveling public.
DECISION
Based on the findings and conclusions, the request for the Summitview Pump Station
Project Development Plan is approved subject to the following conditions:
1. All signed easements and right-of-way dedication documents shall be provided,
along with the filing fees, prior to Final Compliance approval.
2. The escrow amount of $10,500, or any such amount as may be mutually agreed
upon between the City and the District, for the local street improvements, shall be
submitted to the City prior to Final Compliance approval.
3. Final Compliance plans shall show and label the future sidewalk along Timberline
Road running along the back of the road right-of-way.
4. Final Compliance plans shall show and label the future street trees to be located
within the parkway strip of the Timberline Road right-of-way. Such trees shall be
placed on 30 to 40-foot intervals.

4. Findings of Fact/Conclusion:
In evaluating the request, Staff makes the following findings of fact:
A. The requested use is defined as a "public facility" and is permitted as a Type One
use in the L-M-N zone district.
B. There is minimal land development associated with the request. There would be
no structure, building permit or plat. There is only an underground pump facility
with groundcover to replace disturbed areas.
C. The P.D.P. is on a parcel with approximately 250 feet of frontage along
Timberline Road which is classified as a standard arterial street.
D. The pump station is not open to the public. There would be approximately one
trip per day by District staff to the facility.
E. The P.D.P. satisfies the applicable criterion relating to the "local street portion" of
the Timberline Road street improvements by escrowing an amount acceptable to
the Director of Engineering. This escrow will cover the cost of the applicant's
share of the roadway improvements at no risk to the traveling public.
STAFF RECOMMENDATION:
Staff recommends approval of Summitview Pump Station, P.D.P., 5-01, subject to the
following condition:
All signed easements and right-of-way dedication documents shall be
provided, along with the filing fees, prior to Final Compliance approval.
2. The escrow amount of $10,500, or any such amount as may be mutually
agreed upon between the City and the District, for the local street
improvements shall be submitted to the City prior to Final Compliance
approval.

There has been no previous planning or land development activity on this parcel.
2. Land Use:
The proposed underground pump station is considered a "public facility." This is a
Type One permitted land use in the L-M-N zone district.
3. General Development Standards:
The request is for a fully automated, unmanned water pumping facility placed
underground. There are no above -ground buildings. No building permit will be
issued. There is no plat. There is no fencing. The only landscaping is groundcover.
The access road is the existing ditch rider's road along the irrigation canal. The
P.D.P. satisfies the applicable General Development Standard as described below:
Section 3.3.2(E)(1) — Required Improvements Prior to Issuance of Certificate of
Occupancy:
This section requires an applicant, whose project is located adjacent to any
existing street right-of-way, to improve the street to the full local street standard.
Or, if located adjacent to a collector or standard arterial, the applicant shall
improve one-half of the width of such a street.
In cases where the strict interpretation of this provision would place undue
hardship upon the applicant, and the health, safety and welfare of the public
would not be placed at risk, the applicant may be permitted to establish an
escrow account, based on current cost estimates, which will cover the cost of
completion of the required street improvements.
The P.D.P. satisfies this requirement. It is anticipated that there will be
approximately one trip per day by District staff to the proposed facility. This
impact does not warrant construction of street improvements at this time and
establishment of an escrow is acceptable.
There is approximately 250 feet of street frontage along Timberline Road. To
improve this frontage, the applicant would be responsible for the "local street
portion" of the full arterial improvement. At the current estimate of $35 per lineal
foot, the escrow is estimated to be $10,500, or such amount as may be mutually
agreed upon between the City and the District. This escrow amount has been
reviewed by the Director of Engineering and found acceptable. The escrow
amount will be presented to the Engineering Department upon Final Compliance.

PUBLIC HEARING
After reviewing the Staff Report and recommendation, a public hearing was held on the
subject application at 3:00 PM on April 20, 2001. The hearing was held in Conference
Room D at 281 North College, Fort Collins, Colorado.
