DECISION
The Meldrum/Myrtle Four-Plex Project Development Plan #13-01 is hereby approved by
the Hearing Officer without condition.

general comments from those in attendance established a need for greater housing
opportunities within the area such as the proposed four-plex.
Non-resident owners of nearby multifamily and rental properties testified that there
exists a serious demand for additional off-street and public parking in the general
vicinity of the PDP. In addition, the proposed four-plex would be likely used for the
housing of university student populations. Testimony further established that
student populations often generate a higher demand for parking than other types of
residential users due to the greater number of drivers residing within each residential
dwelling unit. While these concerns may be relevant to the City for purposes of
reviewing the parking standards applicable to this type of multifamily use within this
area, the testimony and the Staff Report established that this project met or
exceeded the parking standard made applicable to the proposed use by the Fort
Collins Land Use Code.
2. Compliance with Article 4 and the LMN District Standards: The Project
Development Plan complies with all applicable requirements of Article 4 and the
Neighborhood Conservation, Buffer District (NCB). The Staff Report summarizes
the PDP's compliance with these standards and no specific evidence was presented
to contradict the statements and conclusion of the staff report concerning
compliance or to otherwise refute the compliance with Article 4 or the NCB District
Standards.
3. Compliance with Article 3 — General Development Standards: The Project
Development Plan complies with all applicable requirements of Article 3. No
evidence was presented to contradict the statements and conclusion of the staff
report concerning compliance or to otherwise refute the compliance with the Article 3
Standards
SUMMARY OF CONCLUSIONS
A. The proposed land uses are permitted in the Neighborhood Conservation Buffer
zone district.
B. The Project Development Plan complies with all applicable district standards of
Section 4.8 of the Land Use Code, Neighborhood Conservation zone district.

NOTICE OF PUBLIC HEARING AND NEIGHBORHOOD MEETING: Evidence
presented to the Hearing Officer established no controversy or facts to refute that the
hearing was properly posted, legal notice mailed, and notice published. A
neighborhood meeting was not required and was not held.
PUBLIC HEARING: The Hearing Officer, presiding pursuant to the Fort Collins Land
Use Code, opened the hearing at approximately 8:45 p.m. on November 14, 2001 in a
conference room of the City of Fort Collins Planning Department located at 281 North
College Avenue, Fort Collins, Colorado.
RECORD OF HEARING: The Hearing Officer accepted during the hearing the
following evidence: (1) Planning Department Staff Report; (2) application, plans, maps,
and other supporting documents submitted by the applicant and the applicant's agents
to the City of Fort Collins; (3) a sign-up sheet of persons attending the hearing and
citizens speaking in favor of or against the application; and (4) a tape recording of
testimony provided during the hearing. The LUC, the City's Comprehensive Plan, and
the formally promulgated policies of the City are all considered part of the evidence
considered by the Hearing Officer.
FACTS AND FINDINGS
1. Compatible with Surrounding Uses: The proposed development is adjacent to
the following surrounding zoning and land uses:
N: NCB — single family residential
S: NCB — single family residential
E: CC — Office Building
W: NCB — single family residential
The testimony and evidence presented by the Applicant and the City staff
established that the use proposed by the PDP was generally consistent with other
adjacent and neighboring land uses. A multi -family residential building, with up to
four units, is a permitted use in the NCB zone district subject to administrative
review. The mass, height, and architecture of the proposed building was found
generally consistent with adjacent structures and the project presents a logical
transition (in terms of height, mass, intensity of use, architectural style, and location
of parking area) between the immediate adjacent uses to the east and west. Other

PROJECT DESCRIPTION AND BACKGROUND: The. Meld ru m/Myrtle Four-Plex is a
project development plan (PDP) for a four unit multi -family dwelling located at the
southeast corner of Meldrum Street and Myrtle Street. The four-plex will be located
behind two existing detached single family dwellings and will face onto Myrtle Street.
The project will gain access from the adjacent alley. Off-street parking will be provided
in both a surface lot and in garages incorporated into the building. The two existing
houses along Meldrum Street will remain in place and other than private easements to
accommodate sidewalk and landscaping improvements required for the four-plex, these
existing residential uses will not be altered. A subdivision plat accompanies the PDP.
The plat will create a lot upon which the proposed four-plex will be constructed. The
property was annexed in 1873 as part of the City of Fort Collins Annexation.
