Subject: VOA Variances
Based on my meeting yesterday with the designers and others concerning the VOA project, the
designers indicated a need for 3 variances for the project, as follows:
1. LUC 3.6.3 (C) requires 1320-ft spacing for potentially signalized collector or local street access to
arterials. I do not think this applies to Kunz Court, since it must be aligned with the existing Seneca
Street intersection with Horsetooth Road. No variance or modification should be necessary in order to
approve the Kunz/Horsetooth intersection location as designed.
2. LCUASS 19.3.1 and Standard Drawing 19-03 --- I feel that the 20-ft parking space setbacks shown
on the plans will not present a hazard to public safety, so I agree to grant a variance to the apparent 40-ft
requirement in our standards, in this case.
3. LCUASS Standard Drawings 7-29 A & B --- The SW parking area will also serve as an overflow
conduit for the stormwater detention pond to the west. Therefore, it makes sense to allow the drive
approach design shown in 7-29 B in order that the potential storm flows remain within the paved area.
Using 7-29 A would create in effect a dam at the sidewalk crossing. If a variance is necessary to use the
7-29 B design for that one parking lot, then I will authorize it.
Let me know if you have any questions on these. In the interest of time, it will not be necessary for the
designer to submit variance requests for these items. If other design details come into question over
conflicts with our standards, please let me know immediately. As usual, granting of these variances will
not be used to set a precedent for other similar variances on other projects. The standards remain as
written until changed.
