HomeMy WebLinkAboutREDTAIL RESIDENTIAL - PDP - 26-01 - CORRESPONDENCE - ALTERNATIVE COMPLIANCE REQUESTAlternative Compliance for Part of North Property Line Parking Screening from Adiacent Non-residential Uses This is with regard to LUC 3.2.1(e)(4)(b) Screening parking from adjacent non- residential uses and 3.2.1(iv) Alternative Compliance and LUC Landscape Section Purposes 3.2.1(b): There is a large warehouse (previously Webergs) immediately adjacent to the north of our site. This warehouse is well set back, has a substantial berm, and many mature evergreen trees along the south side of such warehouse. The purpose of the screening requirement is so that adjacent neighbors will not have to look at our parking lot without some screening / buffering. This purpose, however, is not relevant in this situation because our parking fronts a thin strip of grass, mature trees and a long warehouse wall with no windows in it. Accordingly, we are proposing alternative compliance for the practical reasons that a) the screening provision has no benefit as intended, as described above, and b) our Mill Farm residents would benefit from the aesthetic experience and their parking lot would be enhanced by not installing such screening but rather enjoying the view of a green banking of grass sloping up and away from the parking lot with many large mature evergreen trees buffering the warehouse wall, which would be coupled with shade trees planted along the edge of the property. This achieves the screening purposes equally well as a plan which complies with the screening requirement because since a landscape screen installed here would serve no function then the absence of a landscape screen is equally as good. Also, our alternative compliance plan preserves and incorporates this adjacent landscaping and vegetation into our landscape plan. And our alternative plan enhances the landscape continuity and connectivity between our residential use and the adjacent industrial use. Furthermore, our alternative plan achieves the LUC landscaping purposes of a) providing significant canopy shading with the new deciduous trees we are planting, b) contributes to the visual quality and continuity between our development and the adjacent development, and c) enhances the outdoor spaces involved. Accordingly, the five foot landscape setback along the north edge of our property has been waived in light of the fact that there are a substantial and very attractive berm, grass and established trees immediately adjacent to the north and furthermore that the benefit of any screening here is primarily to screen our private drive'from 300 feet of windowless warehouse wall and visa versa.
