The trail inside the BNSF right-of-way is actually being pursued
as part of another project, called the Mason Transportation Corridor, by
the City of Fort Collins. I am on the consultant team as the Railroad
Coordinator for the Mason Transportation Corridor and am currently
working through the logistics of this trail with Lyn Hartley at the
BNSF. We have not yet engaged Staubach as we have not finalized the
alignment and worked through all of the particulars with the BNSF.
In the near future, I will be contacting you regarding the trail
alignment inside the BNSF right-of-way. But for now, I wanted to let
you know that we are not quite ready to pursue requesting use of the
BNSF right-of-way, so you would not be awaiting additional information
with regard to this trail.
Please contact me if you should have any questions regarding
this issue.
Thank you.

OK. If you are pursuing the trail under a separate transaction, I do
not need any further information. Thanks for the update.

You received a package containing a site plan for the Redtail
Residential and Office Park from Troy Jones at the City of Fort Collins,
Colorado. It involved a possible future trail alignment inside the BNSF
right-of-way (Powder River Division, Front Range Sub, L.S. 0476, MP 69.0
- 69.25). You responded in writing to the City in a letter dated March
14, 2003 that additional information would be required.
The City sent the site plan out of courtesy for the railroad's
information, but did not realize that it could be construed as an
application for right-of-way use (which would clearly require additional
information). They asked me to contact you to clarify the situation.
There won't be any additional information sent as part of the Redtail
Residential and Office Park, because that development does not actually
include the proposed trail inside the BNSF right-of-way. That
development only includes the trails outside the right-of-way, which
will eventually connect to the segment inside BNSF right-of-way.
