REUTZEL of Counsel E-MAIL: sulery@dsrlaw.com August 17, 2001 Re: Proposed group home to be located on Lot 69, The Ponds at Overland Trail, Second Filing We represent Overland Trail, LLC, ("Overland") the assignee of the Declarant's rights under the Declaration of Covenants, Conditions and Restrictions of The Ponds at Overland Trail ("Declaration"). As Declarant, Overland has appointed the Architectural Review Committee pursuant to Article V of the Declaration. Article V requires that all plans and specifications for Improvements to be constructed upon any Unit be approved by the Architectural Review Committee. Although you have not yet submitted plans and specifications to the Architectural Review Committee for approval, we were notified by the City of Fort Collins on or about the third week of July that you intend to operate a group home in your Unit. The Executive Board of The Ponds at Overland Trail Homeowners Association, Inc. has informed Overland that it has unanimously concluded that a group home is a business, commercial or professional use prohibited by Article IX, Paragraph 3 of the Declaration. Consequently, this letter is to inform you that the Architectural Review Committee will not approve any plans submitted to it for Improvements io be construcied on Lot 69 so long as the Improvements are contemplated to be used for a purpose prohibited under the Declaration.
