Request for Alternative Compliance
SideHill (Johnson Property) Overall Development Plan
April 7. 2003
The applicant. James Company, is requesting Alternative Compliance to reduce the required
separation distance between street trees and driveways and between street trees and utilities.
Section 3.2.1 (D) (2) (a) states that street trees shall be placed at least eight (8) feet away from the
edges of driveways and alleys. The applicant requests a reduction in separation distance from
eight (8) feet down to six (6) feet where needed.
Section 3.2.1 (K) (2) states that street trees should be placed a minimum of ten (10) feet away
from water or sewer lines. The applicant requests a reduction in separation distance from
ten (10) feet down to eight (8) feet where needed.
Based upon criteria provided in the Fort Collins Land Use Code (L.U.C.) Section 3.2.1 (N), the
applicant maintains that the proposed decrease in separation distance between street trees and
driveways and street trees and water or sewer lines accomplishes the purposes of L.U.C. Section
3.2.1 equally as well or better than a plan that complies with the standards.
When compared to a plan compliant with the Land Use Code standards:
• The proposed plan is better than a plan compliant with the Land Use Code because the
proposed street tree separation distances would allow for more street trees per block and a
fuller more complete street tree canopy.
■ I he proposed plan will allow Tor greater densities within singie-tarniiy resiaential front Icaded
residential developments because lot width can remain at the required minimum of 50' in width.
(Note: Lots impacted by these standards are both forty-nine (49) feet and fifty -feet (50) in width.
Please see the attached plans showing the proposed plan as well as a plan that is compliant with
the Land Use Code standards.
