This project is also proposed to be under an HOA subject to the (existing) Fossil Lake Ranch HOA and, therefore, subject to the architectural controls established by that HOA. Applicant suggests that such considerations and controls are sufficient. 83. Applicant will procure said easement(s) if required. Applicant will facilitate any needed easements relative to the above. Applicant requests that overall project approval not be delayed on the basis of this (potential) issue. 31. Sheri Wamhoff-Engineering-Utility Plans Tncia Kroetch [This comment was retained from the previous review cycle.] A variance was requested on October 8, 2002, In the response dated November 22, 2002, the variance was granted relative to the southeast driveway was conditionally approved. The conditional changes have been incorporated into the revised plans re -submitted herewith. In the response dated November 22, 2002, the variance relative to the northwest driveway was denied. The site grading plans have been revised so as to reduce the square footage area to approximately 760 square feet. Applicant notes that any impact of the required temporary turnaround should be considered as irrelevant to this sheet flow issue. 51. Troy Jones -Current Planning -General Brad Massey [This comment was retained from the previous review cycle.] Applicant maintains that the neighborhood concern with compatibility is much more related to density than to elevations and architecture. The former issue (density) has been extensively debated and considered and Applicant believes it best to continue as entitled (e.g., as per the revised submission reflecting 80 dwelling units as opposed to the original submission reflecting 78 units). As to elevations and architecture, Applicant has held additional meetings with interested neighbors, with a primary purpose of presenting and discussing possible alterations to the elevations. Changes have been incorporated which incorporate a number of neighbor suggestions while not forcing the Applicant to redesign the basic structures. Changes include the use of stone in lieu of brick, the enhancement and emphasis of porch elements, and additional variations in siding materials. Applicant is well aware that not everyone will be completely pleased —and that there are some who will never be pleased at all. Applicant believes it has made every reasonable effort, and then some, to address issues of architectural compatibility. 57. However, because the Applicant is proposing the use of residential (building -mounted) lights rather than commercial, photometric data is not available. a. Primary site lighting to be provided via wall mounted fixtures at garage elevations. b. (Private) pole lighting to be included only in areas where the above provides insufficient lighting for general security purposes. c. The photometric plan does not address any (street) lighting that may be installed by the City. It would be very helpful to have these locations for coordination purposes. 71. Primary location and coordination concerns of all utilities were addressed. It was agreed that L&P, AT&T and Qwest would be joint -trenched. Satisfactory transformer and meter bank locations were also identified. Tree locations will be adjusted once all utility line locations are finalized. An actual utility pre -con meeting will be held at a later date. 10.
