The only issue I have is the project not having to do the CR36/Trilby access earlier than Ph. 3/4. We
continually wrestle with issues of inadequate access or connectivity to corridors due to project phasing. On
small projects its not an issue. It is on large projects though. If this development slows and the other
approved areas build out, the residents and users will be waiting to get the needed connections. We may
also have to approve other developments that could impact this deficiency indirectly. Being indirectly also
ties our hands in getting mitigations from other impacting developments. The South
Shields/Troutman/Seneca/Wabash area is one example of this problem.
I know this is ultimately the County s call but I know Rusty had some issues with the CR36 improvements,
east and west of CR9. Mine were west and his were east. Mine may have also included the east section
had I had the understanding that they were not having to do improvements until the later phases.
Unfortunately we had played phone tag several times at a time when I didn't know he was leaving. So we
didn't get to discuss our concerns together.
I'm sure this is too late, but I still felt a responsibility to provide my input regardless.
Since the improvements issue has been pretty well settled I do not see a need to attend. If I find I have'
something to provide I'll work with the chosen meeting schedule.

As discussed at the 4/10/01 City/County meeting, the applicants for the Everitt Company would like to
informally submit revisions to Fossil Lake 2nd this week, and meet with us next week to discuss the
revisions. Please let me know your availibility on the following dates:

Wednesday - 4/25
Ward - let me know if you don't think you need to be part of this meeting.

Yes, I did get the TIS and can not disagree with the evaluation at CR9/CR36 (Ziegler/Keckter). I ran and
verified Matt's numbers and they do have an acceptable level of service.
Eric and I have started looking at large projects from the standpoint of adequate access not just level of
service at an intersection. The Troutman, Shields, Seneca area is an example of a development area with
access problems. If the future expectations of projects do not happen then at least adequate access is still
in place. Some of the significant complaints we get are desiring signals where we can't put them due to
warrents. People must wait long periods to get access to a roadway not just thru an intersection. That
becomes my concern here. Three-forths of this large development gets its access from two accesses to
the same street. One access' traffic will shadow the other access making it more difficult to get out of the
shadowed access. The larger portion of the site is served from the Trilby Road access which in the
morning will be the shadowwed access. If it becomes a daily backup then people will travel thru the
neighborhood to get to the easier access, increasing VMT's and neighborhood complaints about traffic
and related issues. The access to Cr 36 is just another relief valve to serve a part of the site that is best
served from that side of the development.
A couple of other things I noticed when i was evaluating Matts numbers is that the very first TIS indicated
408 total units and the second and third TIS's indicate 608 units. I'm unable to find any documents that
stated an approval of increased number of units, but I don't see a lot of stuff related to projects. The
intersection still works acceptably but access issues may be increased. Another item was that the TIS
states separate lefts at 36 and 9 at all approaches and an eastbound right turn lane. My latest trip out
there was that eastbound 36 does not have width to accomodate a right turn lane. Has there been
conversation about Fossil Lakes having to construct this indicated improvement, that you have heard ?

Well this is what I know.
They submitted a traffic study, from Matt Delich that stated that the access off of Ziegler (CR9) would be
adequate until Phase 3 of this Development.
It was a question that we had - that was the provided justification. Ward have you seen that?
From what I understand they currently have and will have until the Trilby is built an emergency access in
this location out to Kechter (CR36). I believe this is emergency access only.
We have had a meeting with the School district, Willowbrook and Fossil Lakes to try to get the Kechter Rd
improvements done this year before the school opens. But this is only for Kechter.

Troy, in the development agreement it states that the CR36/Trilby access will take place at Phase 3. Was
it ever discussed that the improvements would take place at the next phase after phase 1 & 2, irregardless
of whether it was phase 3 or 4 ? Possibly giving a time limit for when, as a minimum, the Triby connection
is made to CR36 ? Even if separating the improvements was necessary, the connection is most important
to me and the CR36 improvements could come later.
