HomeMy WebLinkAboutFOSSIL LAKE P.U.D., SECOND FILING - COUNTY APPROVAL - 33-01E - CORRESPONDENCE - (3)(I) A written legal description of the boundaries of the area proposed to be annexed; (II) A map showing the boundary of the area proposed to be annexed; (III) Within the annexation boundary map, a showing of the location of each ownership tract in unplatted land and, if part or all of the area is platted, the boundaries and the plat numbers of plots or of lots and blocks, (IV) Next to the boundary of the area proposed to be annexed, a drawing of the contiguous boundary of the annexing municipality and the contiguous boundary of any other municipality abutting the area proposed to be annexed. " Logistically, it will be difficult for the City to prepare the annexation map and legal description to proceed with annexation, but if the developer provides the above items, the city can more easily proceed with the annexation. 2. Current Planning - We request that the development agreement stipulate that the developer will submit a complete application for annexation on or around 120 days before the anticipated date of final plat approval, and that the County may withhold issuing building permits for the development up to 120 days following the submittal of the annexation application by the City if necessary to allow the City to complete the annexation. 3. Please see the attached comment sheets from, Engineering, Transportation Planning, and Advance Planning. 4. A portion of the 5tormwater comments are included. The remainder of the 5tormwater comments will be available by late next week. 5. Current Planning - I noticed on the Annexation Agreement proposed for this project that it states in item #1 that, "the OWNER specifically agrees to consent to and join in the annexation of such territory," and goes on to say, "any fees normally collected at the time of annexation shall not be the obligation of the OWNER." Ideally, the City would like the developer to submit an annexation application (or a series of annexation applications) in accordance with our standard fee and submittal requirements. The City would like the County to require that the developer be the applicant for annexation. If the County does not have the authority to require the developer to apply to the City to annex, we request that the developer be required to submit the annexation map and legal description in accordance with CPS 31-12-107 subsection (1)(d) which states: "(d) Accompanying the petition shall be four copies of an annexation map containing the following information: 281 North College Avenue • P.O.
