The Fossil Lake, Project Development Plan, 4th Filing is subject to administrative review and the requirements of the Land Use Code (LUC). B. The Fossil Lake, Project, Development Plan, 4th Filing is consistent with the approved Fossil Lake PUD 1st Filing. C. The Fossil Lake, Project Development Plan, 4th Filing satisfies the development standards of the LMN zoning district. D. The Fossil Lake, Project Development Plan, 4th Filing, complies with all applicable General Development Standards contained in Article 3 of the Land Use Code. DECISION The Fossil Lake, Project Development Plan, 4th Filing, #33-01 G, is hereby approved by the Hearing Officer without condition. Dated this 19th day of June 2003, per authority granted by Sections 1.4.9(E) and 2.1 of the Land Use Code. Cameron Glos Current Planning Director Fossil Lake PDP, 411h Filing Administrative Hearing Findings, Conclusions, and Decision June 18, 2003 Page 3 of 4 FACTS AND FINDINGS The surrounding zoning and land uses are as follows: N: FA1 — Farming in Larimer County — farm land, one rural residential farmstead, E: LMN — Approved First and Second Filings of Fossil Lake P.U.D. including an existing neighborhood center and neighborhood park, S: LMN —Approved 1 st filing of Fossil Lake P.U.D., UE - Approved 1st filing of Fossil Lake P.U.D., W: FA1 — Farming in Larimer County — Homestead P.U.D. Second Filing (under review by Larimer County). 1. Compliance with the Approved Overall Development Plan The Project Development Plan is consistent with the Fossil Lake PUD, 1st Filing, and was identified on that approval as "Tract A' . No evidence was presented to contradict the staff report and its statements and conclusions relative to compliance with this approved plan. 2. Compliance with Article 4 and the LMN Zoning District Standards: The Project Development Plan complies with all applicable requirements of Article 4 and the LMN Zoning District. The Staff Report summarizes the PDP's compliance with these specific standards and no specific evidence was presented to contradict the statements and conclusion of the staff report concerning compliance with Article 4 or the LMN District Standards. 3. Compliance with Article 3 of the Land Use Code — General Development Standards The Project Development Plan complies with all applicable requirements of Article 3 including the plat standards of Section 3.3.1. No evidence was presented to contradict the statements and conclusion of the staff report concerning compliance or to otherwise refute the compliance with Article 3. Fossil Lake PDP, 4"" Filing Administrative Hearing Findings, Conclusions, and Decision June 18, 2003 Page 2 of 4 NOTICE OF PUBLIC HEARING: Evidence presented to the Hearing Officer established no controversy or facts to refute that the hearing was properly posted, legal notices mailed and notice published. The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the hearing at approximately 5:30 p.m. on June 18, 2003 in Conference Room A and B at 281 North College Avenue, Fort Collins, Colorado. HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE: The Hearing Officer accepted during the hearing the following evidence: (1) Planning Department Staff Report; (2) application, plans, maps and other supporting documents submitted by the applicant and the applicant's representatives to the City of Fort Collins; (3) a sign up sheet of persons attending the hearing; and (4) a tape recording of discussion at the hearing. The LUC, the City's Comprehensive Plan (City Plan), and the formally promulgated policies of the City are all considered part of the evidence considered by the Hearing Officer. Box 1845 Cameron Gloss Current Planning Director This is a request to construct 80 multi -family dwelling units (condominiums) on 7.5 acres at the northeast corner of Ziegler Road and Shallow Pond Drive. The site will be bisected by the northerly extension of Dripping Rock Lane, and there will be an additional east -west public street connection provided from the development to Ziegler Road on the north end of the development. Proposed are five (5) three -bedroom units with attached two -car garages, and seventy-five (75) two -bedroom units with single -car attached garages. The units are distributed among eight six-plex and eight four-plex buildings. The applicant intends that all units will be marketed for -sale.
