B. The Harmony-Lawser Subdivision conforms to standards of the HC zoning
district.
C. The Harmony-Lawser Subdivision conforms to the applicable plat standards as
put forth in the Land Use Code.
D. Future development of the property will be required to meet Land Use Code
Division 2.7 BUILDING PERMITS.
DECISION .
Based on the findings and conclusions, the Harmony-Lawser Subdivision is approved.
Dated this 19th day of November 2001, per authority granted by Sections 1.4.9(E) and
2.1 of the Land Use Code.

2) The general layout of lots, roads, driveways, utilities, drainage
facilities and other services adjacent to this parcel were previously
created by other subdivisions. The design of the adjacent roads are
unaffected.
C. Section 3.3.1(C) Public Sites, Reservations and Dedications:
1) All rights -of -way adjacent to or within the plat have been dedicated
by a previous subdivision plat or deed of dedication, and are of
adequate size for the infrastructure they contain. The subdivision
plat will dedicate an access and utility easement and a ditch
easement.
2) Subdividing the land will not result in the need for additional open
space or detention areas.
4. Findings of Fact:
In reviewing the request for the Harmony-Lawser Subdivision, Staff makes the following
findings of fact:
A. The Harmony-Lawser Subdivision contains an office use, which is
permitted in the HC — Harmony Corridor Zone District.
B. The Harmony-Lawser Subdivision meets the procedural requirements
located in Division 2.1 - General Procedural Requirements, Division 2.2 -
Common Development Review Procedures for Development Applications,
and Section 2.4 - Project Development Plan located in Article 2 -
Administration.
C. The Harmony-Lawser Subdivision meets the plat requirements located in
Section 3.3.1 - Plat Standards located in Article 3 - General Development
Standards.
HEARING OFFICER FINDINGS AND CONCLUSIONS
After reviewing the staff report and the record of the public hearing, the Hearing Officer
makes the following findings and conclusions:,
A. The Harmony-Lawser Subdivision is subject to administrative review and the
requirements of the Land Use Code (LUC).

COMMENTS:
1. Background:
The zoning and land uses that surround the Harmony-Lawser Subdivision are as
follows:
N: UE — Single Family Residential
S: HC — Commercial, Retail
W: HC - Office
E: HC - Commercial
This property was annexed into the City as part of the Harmony Half Acres in 1989.
2. Division 4.21 of the Land Use Code, Harmony Corridor Zone District
The subdivision plat meets the applicable Land Use Standards as follows:
The lot has been designed to allow the building to front onto the adjacent street.
3. Article 3 of the Land Use Code — General Development Standards
A. Section 3.3.1(A), General Provisions:
1) The subdivision plat will be filed and recorded only after having
been approved by the Director of Planning, with such approval
evidenced in writing on the plat and signed by the City Clerk. This
plat is necessary to establish a legally defined lot upon which a
change of use may occur with the, existing building. A minor
amendment has already been approved for the change of use,
however a condition was placed on the modification requiring a
subdivision plat to be submitted and approved prior to the issuance
of a building permit.
B. Section 3.3.1(B), Lots:
1) This lot has direct vehicular access to the adjacent public street,
and does not have access to more than one street. The side lot
lines are substantially at right angles to the street. There is no
minimum lot size for commercial uses within the HC-Harmony-
Corridor Zone District.

NOTICE OF PUBLIC HEARING: Notice of public hearing was made on November 2,
2001 by mailing to property owners within 500 feet of the subject property.
The public hearing was advertised in the Coloradoan.
PUBLIC HEARING
After reviewing the Staff Reportand recommendation, a public hearing was held on the
subject application at 2:00 PM on November 16, 2001. The hearing was held in
Conference Room A at 281 North College, Fort Collins, Colorado.

PROJECT DESCRIPTION:
The Harmony-Lawser Subdivision encompasses 0.32 acres of land located north of
Harmony Road, west of Timberline Road. The subdivision plat will create a legal parcel
of land for the property, which is currently unplatted. The property is zoned HC -
Harmony Corridor, and is currently used for an insurance office.
