Testimony was offered at the hearing by neighboring property owners concerning the anticipated and feared impacts of site redevelopment on vehicular circulation. There are no limitations created through the subdivision plat eliminating existing cross -access to abutting properties. The applicant stated that no development is proposed on Lot 2 at the present time. Future development on that lot will be subject to the Type I administrative review process. SUMMARY OF CONCLUSIONS A. The Replat No. 2 of the University Shopping Center Subdivision, Project Development Plan, is subject to administrative review and the requirements of the Land Use Code (LUC). B. The Replat No. 2 of the University Shopping Center Subdivision, Project Development Plan satisfies the development standards of the C zoning district. C. The Replat No. 2 of the University Shopping Center Subdivision, Project Development Plan complies with all applicable General Development Standards contained in Article 3 of the Land Use Code. DECISION The Replat No. 2 of the University Shopping Center Subdivision, Project Development Plan #40-01, is hereby approved by the Hearing Officer without condition. College Ave. Written Comments: None FACTS AND FINDINGS The surrounding zoning and land uses are as follows: N: C; existing commercial S: C; existing commercial W: CSU; Colorado State University E: RL; existing single family residential This property was annexed into the City as part of the South College Avenue Consolidated Annexation in April, 1957 and the Laidlaw Annexation in June, 1958. The property was subdivided as part of Tract 'D' of the University Shopping Center Subdivision in May, 1959. The purpose for the replat of a portion of the University Shopping Center Subdivision is to create two lots on a property that presently is a portion of a previously subdivided tract of land. The 2-lot subdivision plat will create two lots, one being 6.24 acres in size (Lot 1) and the other being 0.31 acre in size (Lot 2). The replat is a result of a recent redevelopment request for the old Montgomery Wards site. 1. Compliance with Article 4 and the C Zoning District Standards: The Project Development Plan complies with all applicable requirements of Article 4 and the C Zoning District. The Staff Report summarizes the PDP's compliance with these specific standards and no specific evidence was presented to contradict the statements and conclusion of the staff report concerning compliance with Article 4 or the C District Standards. 2. Compliance with Article 3 of the Land Use Code — General Development Standards The Project Development Plan complies with all applicable requirements of Article 3 including limitations on vehicular access to and from the adjacent public street and existing cross -access to adjoining properties. The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the hearing at approximately 3:00 p.m. on March 27, 2002 in Conference Rooms C and D at 281 North College Avenue, Fort Collins, Colorado. HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE: The Hearing Officer accepted during the hearing the following evidence: (1) Planning Department Staff Report; (2) application, plans, maps and other supporting documents submitted by the applicant and the applicant's representatives to the City of Fort Collins; (3) a sign up sheet of persons attending the hearing and citizens speaking in favor of or against the application; and (4) a tape recording of testimony provided during the hearing. The LUC, the City's Comprehensive Plan (City Plan), and the formally promulgated policies of the City are all considered part of the evidence considered by the Hearing Officer.
