RECOMMENDATION:
Staff recommends approval of "the Replat No. 2 of the University Shopping
Center — Subdivision - #40-01.':
A. The subdivision plat is in compliance with Section 3.3.1(A) General
Provisions in that:
1) The subdivision plat will be filed and recorded only after having been
approved by the Director of Planning, with such approval evidenced in
writing on the plat and signed by the City Clerk.
B. The subdivision plat is in compliance with Section 3.3.1(B) Lots in that:
1) The lots have direct vehicular access to a public street (South College
Avenue), and the side lot lines are substantially at right angles or
radial to the street lines.
2) The general layout of lots, roads, driveways, utilities, drainage
facilities and other services within the proposed development have
been previously established in the surrounding commercial center.
C. The subdivision plat is in. compliance with Section 3.3.1(C) Public Sites,
Reservations and Dedications in that:

1) An applicant shall be required to dedicate rights -of way for public
streets, drainage easements and utility easements as needed to serve
the area being platted.; The, right-of-way for South College Avenue was
previously dedicated by separate documents and the drainage and
utility easements necessary"to serve this lot will be dedicated with the
Replat No. 2 of the University Shopping Center subdivision plat, if
approved and filed.
2) Reservation of sites for flood control, open space and other municipal
uses shall be made in accordance with the requirements of this Land
Use Code. This criteria is not applicable to the Replat No. 2 of the
University Shopping Center - Subdivision request.
5. Findings of Fact/Conclusion:
A. The Replat No. 2 of the University Shopping Center - Subdivision
contains permitted uses in theC - Commercial Zoning District.
B. The Replat No. 2 of the University Shopping Center - Subdivision meets
the procedural requirements located in Division 2.1 - General Procedural

Requirements, Division 2.2 -'Common Development Review Procedures
for Development Applications, and Section 2.4 - Project Development
Plan located in Article 2 - Administration.
C. The Replat No. 2 of the University Shopping Center - Subdivision meets
the plat requirements located in Section 3.3.1 - Plat Standards located in
Article 3 - General Development Standards.
COMMENTS:
1. Background:
The surrounding zoning and land. uses are as follows:
N: C; existing commercial
S: C; existing commercial
W: CSU; Colorado State University
E: RL; existing single family residential
This property was annexed into the.City as part of the South College Avenue
Consolidated Annexation in April, 1957 and the Laidlaw Annexation in June,
1958.
The property was subdivided as part of Tract `D' of the University Shopping
Center Subdivision in May, 1959.
2. Purpose of the Subdivision:
The purpose for the replat of a portion of the University Shopping Center
Subdivision is to create two lots on a property that presently is a portion of a
previously subdivided tract of land. The 2-lot subdivision plat will create two lots,
one being 6.24 acres in size (Lot 1) and the other being 0.31 acre in size (Lot 2).
The replat is a result of a recent. redevelopment request for the old Montgomery
Wards site. Staff has determined that there is no detriment to the development
plan associated with the platting of the two lots.
3. Article 2 - Administration:
The Replat No. 2 of the University�Sh�opping Center — Subdivision complies with
the applicable requirements of *the LUC, specifically the procedural requirements
located in Division 2.1 - General Procedural Requirements, Division 2.2 -
Common Development Review Procedures for Development Applications, and
Section 2.4 - Project Development Plan located in Article 2 - Administration.
4. Article 3 - General Development Standards:
The Replat No. 2 of the University Shopping Center - Subdivision complies with
the applicable requirements of the LUC, specifically the plat requirements
located in Section 3.3.1 - Plat Standards located in Article 3 - General
Development Standards.

PROJECT DESCRIPTION:
This is a request to replat a portion of Tract 'D' of the existing University
Shopping Center subdivision plat into two lots, one being 6.24 acres in size and
the other being 0.31 acre in size. The site is currently developed, being a vacant
building and parking lot (formerly.the Montgomery Wards Department Store and
associated parking). The property is located on the west side of South College
Avenue between Prospect Road and Drake Road. It is in the C — Commercial
Zoning District.
RECOMMENDATION: Approval
EXECUTIVE SUMMARY:
This request to create a 2-lot subdivision plat for a property that presently is a
portion of Tract 'D' of the University Shopping Center complies with the
applicable requirements of the Land Use Code (LUC), specifically the procedural
requirements located in Division 2.1 - General Procedural Requirements, Division
2.2 - Common Development Review Procedures for Development Applications,
and Division 2.4 - Project Development Plan located in Article 2 -

General Development Standards.
