Steve,
I am responding to the flood and grading concerns expressed by Karla Cummings, 1213
Springfield Drive, Fort Collins, as they relate to the Bennett Road Bungalows development.
She wrote "Especially making sure that the current residents are safe (from flood) ... I surely did
not realize that when the proposal was approved that each home was to be put on it's own little
hill ..."
The flood issue comes from a potential spill out of an irrigation ditch to the west of the site. The
water used to flow east across the site and into the back yards of Ms. Cummings' home and
others. With this development the water will now flow in a ditch on the north side of the Bennett
Road Bungalows and in Bennett Road itself instead of into their back yards. When the last house
on the west end of the development is built, the site grading will block the spill from the ditch
from entering the ditch and all of the flow will be contained in Bennett Road.
The entire site drainage system is installed in accordance with the approved plans and was
certified by Northern Engineering on December 27, 2002.
The individual structures are also graded in accordance with the approved plans. Each lot that
has a Certificate of Occupancy has provided us with a grading certification. The builder did
request that from lot 7 on to the west end of the development, that the homes be lowered one foot
from the approved plan and has demonstrated that the grading will work. We have approved his
request. Each home being elevated "on a little hill" is what is shown on the approved plan. The
reason it appears that way is the back of the lots needed to be lowered to contain the runoff from
the lots and convey it east to the detention pond. In addition the fronts of the homes needed to be
high enough to contain the irrigation spill in Bennett Road. As with all in -fill sites, space is
limited so grading is more difficult.
We were also contacted about the fences crossing the swale in the back yards. The fences that
have been installed are raised above the concrete pan the appropriate height to allow the 100 year
runoff from the back yards to pass safely under the fences.
I hope this addresses the concerns of the flood and grading. Let me know if I can be of further

Subject: Fwd: Bennett Road Bungalows
The Bennett Road Bungalows project is developing in accordance with the approved Site, Landscape,
utility, grading & drainage plans and subdivision plat. There had been references to the buildings being,
generally, 1 story and 1-1/2 story structures (up to 28' in height) during the neighborhood meeting and
development review process.
The Administrative Hearing Officer found, in the Findings, Conclusions, and Decision document (in the
Building and Project Compatibility section) that the project is compatible with the surrounding
neighborhoods in terms of lot size and building heights. The hearing officer heard testimony from
neighboring property owners who challenged the compatibility of the proposed single family units,
comparing the 1 story homes found in the adjacent subdivision (Western Heights) to the proposed 1-1/2
story units of the Bennett Road Bungalows. The hearing officer found that the 1-1/2 story single family
units do not exceed the height limit prescribed in Section 4.3(D)(2)(e) of the Land Use Code (being 28').
The evidence also revealed that in addition to the adjacent ranch -style homes, other adjacent
neighborhoods include one and two story single family residences. As pointed out by the City Planner,
compatibility does not require identical design and architectural features. The Bennett Road Bungalows
Site Plan that was reviewed and approved by the Administrative Hearing Officer (and since recorded) did
commit to and set forth a maximum building height of 28'. The Zoning Department has ensured, during
building permit application reviews, that no structure has exceeded the maximum height of 28'. Currently,
there are structures 1, 1-1/2, and 2 stories in height that are constructed.
The site grading and individual lot elevations are in accordance with the approved grading and drainage
plan. The lots have been elevated to provide proper drainage for storm water from the west through and
around the Bennett Road Bungalows development via a drainage channel along the north side of the
development (in a 7' wide drainage easement)and in Bennett Road to the south. This system improves the
storm drainage on the lots to the north, in the Western Heights Subdivision. Please see the attached
response from the Stormwater Utility.
From the utility access and provision standpoint, the Bennett Road Bungalows subdivision plat dedicates
an 8' wide utility easement along the north property line of the development. The recorded Western
Heights subdivision plat dedicates a 1 Q' wide utility easement along the rear property line of the lots on the
south side of Springfield Drive. Utility providers have an absolute right to access their utilities via the
dedicated utility easements.
