There needs to be a satisfactory recorded written agreement with the developer recognizing The Pleasant Valley and Lake Canal Company's rights, which would include any headgate and measuring device, and there needs to be a legal description sufficient to identify locations. 3. The drawing submitted shows only the boundaries of the proposed re -zoned area. So, The Pleasant Valley and Lake Canal Company cannot comment on any proposed changes, except to note rights of way as follows: A. The company's right-of-way needs to be recognized so it is confirmed it has a 50-foot total right-of-way along its length, with 35 feet from the centerline of the ditch to the east; and 15 feet from the centerline of the ditch to the west. B. Headgate and lateral located at the north side of the property has at least a 10- foot right-of-way; 5 feet either side of the centerline of the lateral; the gate and Parshall measuring flume and ditches to the flume being on The Pleasant Valley and Lake Canal Company's right-of-way. Grading and Drainage plans will be required at Building Permit Review. Any required drainage easements needed as a result of the site design can be done by separate document or replat at that time. Department: Engineering Issue Contact: Katie Moore Topic: General 3 Please use current City standard plat language (attached). 4 Please dedicate ROW and associated utility easements to Larimer County Urban Area Streets Standards for the continuation of Mariposa Court (residential local street classification) onto the property. The placement of the ROW should not preclude the ability to meet horizontal design standards for a local residential streeet, and should terminate in a cul-de-sac no farther than 660' from Westbury Drive. Exact placement of the ROW should be determined by your engineering consultant. (repeat comment from conceptual review) 5 Please complete the attached Development Agreement information. sheet. A Development Agreement will be required to specity that the public street would have to be built at such time as further development occurs. They would like for an agreement to be in place with this approval that you (the developer) recognizes the right's of the Pleasant Valley and Lake Canal Company. Because the canal easement goes through the property being platted, and because the cananl company does in fact have certain rights, we will require a canal company signature on the Plat document. 11 You may need to establish a formal agreement between you and the canal company before they have a level of comfort to sign the plat. Their concerns are as follows: • legal description sufficient to identify locations, • recognize that there is a 50 foot easement along the canal, 35 feet of which is on the east of the ditch centerline, and 15 feet of which is on teh west side of the ditch centerline, • The headgate and lateral located at the north side of the property has at least a 10 foot right-of-way, five feet on either side of the lateral, • 10 feet of canal company easement needs to be shown, 5 feet on either side, of the gate, the Parshall measuring flume, • Laterals beyond the Parshall measuring flume are in the canal easement. Topic: General 14 Please revise your drawings to address all comments and re -submit 5 copies to the Current Planning Department. Topic: Streets & Circulation 12 Because this site is in the Fort Collins Urban Growth Area (UGA) the City views the property as a likely place in the future for urban intensity of development. You are not required to develop the property at such urban level of intensity, however you'll need to allow for the proper street connections so not to preclude the ability to develop urban level of intensities on the property in the future. To that end, right-of-way for Mariposa Court will need to Page 1
