HomeMy WebLinkAboutWEBSTER FARM ANNEXATION & ZONING - 43-01 - REPORTS - INITIATING RESOLUTIONNo Text NOTICE TO ALL PERSONS INTERESTED: PLEASE TAKE NOTICE that the City Council of the City of Fort Collins has adopted a Resolution initiating annexation proceedings for the Webster Farm Annexation, said Annexation being more particularly described in said Resolution, a copy of which precedes this Notice. That, on February 5, 2002, at the hour of 6:00 p.m., or as soon thereafter as the matter may come on for hearing in the Council Chambers in the City Hall, 300 LaPorte Avenue, Fort Collins, Colorado, the Fort Collins City Council will hold a public hearing upon the annexation petition for the purpose of finding and determining whether the property proposed to be annexed meets the applicable requirements of Colorado law and is considered eligible for annexation. At such hearing, any persons may appear and present such evidence as they may desire. The City of Fort Collins will make reasonable accommodations for access to City services, programs and activities and will make special communication arrangements for persons with disabilities. Said Notice establishes the date, time and place when a public hearing will be held regarding the passage of an annexation ordinance pertaining to the above described property. The City Clerk is directed to publish a copy of this Resolution and said Notice as provided in the Municipal Annexation Act. Mayor ATTEST: City Clerk RESOLUTION 2001-165 OF THE COUNCIL OF THE CITY OF FORT COLLINS FINDING SUBSTANTIAL COMPLIANCE AND INITIATING ANNEXATION PROCEEDINGS FOR THE WEBSTER FARM ANNEXATION WHEREAS, a written petition, together with four (4) prints of an annexation map, was heretofore filed with the City Clerk requesting the annexation of certain property to be known as the Webster Farm Annexation; and WHEREAS, the Council of the City of Fort Collins desires to initiate annexation proceedings in accordance with law. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Council hereby accepts the annexation petition for the Webster Farm Annexation, more particularly described as situate in the County of Larimer, State of Colorado, to wit: A parcel of land being part of the Southwest Quarter (SW1/4) of Section Four (4), the Southeast Quarter (SE1/4) of Section Five (5), and the Northwest Quarter (NW 1/4) of Section Nine (9), all in Township Six North (T.6N.), Range Sixty-eight West (R.68W.) of the Sixth Principal Meridian (6th P.M.), County of Larimer, State of Colorado and being more particularly described as follows: BEGINNING at the West Quarter Corner of said Section 4 and assuming the West line of said SWIA as bearing South 01`45'54" East, being a Grid Bearing of the Colorado State Plane Coordinate System, North Zone, North American Datum 1983/92, a distance of 2553.31 feet with all other bearings contained herein relative thereto: THENCE South 88°53'29" East along the North line of said SWIA a distance of 30.04 feet to the East R.O.W. line of Larimer County Road #9 (Ziegler Road), said point being the TRUE POINT OF BEGINNING; THENCE continuing South 88`53'29" East along the North line of said SW I/4, said line also being the South line of Harmony Farm Annexation a distance of 2624.13 feet to the Center Quarter Corner of said Section 4; THENCE South 01'49'40" East along the East line of said SWIA a distance of 2564.85 feet to the North R.O.W. line of Larimer County Road #36 (LCR #36) (Kechter Road), being along the West line of Willow Brook Annexation No. 1 and along the West line of the Willow Brook Annexation No. 2; THENCE North 87°59'57" West along said North R.O.W. line a distance of 1597.46 AGENDA ITEM SUMMARY I ITEM NUMBER: 24 FORT COLLINS CITY COUNCIL DATE: December 18, 2001FROM• Ted Shepard SUBJECT: Resolution 2001-165 Finding Substantial Compliance and Initiating Annexation Proceedings for the Webster Farm Annexation. RECOMMENDATION: Staff recommends adoption of the Resolution. EXECUTIVE SUMMARY: The Webster Farm Annexation is 156.23 acres in size. The site is approximately one -quarter section of land located on the east side of Ziegler Road (C.R. 99) one-half mile south of Harmony Road. Kechter Road (C.R. #36) forms the southern boundary. Contiguity with the existing municipal boundary is gained along the north, east and west property lines. The proposed Resolution states that it is the City's intent to annex this property and directs that the published notice required by State law be given of the Council's hearing to consider the needed annexation ordinance. The hearing will be held at the time of First Reading of the annexation and zoning ordinances on February 5, 2002. Not less than 30 days prior, published notice is required by State law. T�9 This is a 100% voluntary annexation for a property located within the Urban Growth Area. The property satisfies the requirement that no less than one -sixth of the perimeter boundary be contiguous to the existing City boundary. The parcel is located within the Fossil Creek Reservoir Area Plan.
