5. The site is located in the 100-year floodplain of the Poudre River. The
construction of the new building, therefore, must comply with the new
requirements regarding development in the Poudre River floodplain. For
example, there can be no storage of hazardous materials such as gasoline in drums
that exceed normal household quantities.
6. If the site has been elevated and removed from the floodplain, then it will be
necessary to apply to F.E.M.A. for a Letter of Map Revision. Without such
Letter, the City must enforce its floodplain regulations. These include applying
for a Floodplain Use Permit, elevating two feet above the 100-year base flood
elevation or flood -proofing the building. In addition, there must be dry -land
vehicle access to the building that is above the 100-year base flood elevation.
Trash dumpsters must be tied down and there can be no storage of floatable
materials such as lumber, pallets, tires, etc. Finally, after construction, the
finished floor elevation must be certified to the City. For further information

7. Stormwater detention will not be required. However, treatment of stormwater
runoff will be required before release from the site. A standard Drainage Report,
Grading and Drainage Plan and Erosion Control Plan will be required. For further
information regarding stormwater treatment issues, please contact Glen Schlueter,
221-6681.
8. There is a general development standard that new development shall maintain a
minimum 300 foot setback from the Poudre River as measured from the top of the
bank. It may be helpful to illustrate this setback on the plans.
9. Please be prepared to address whether or not there are any impacts on existing
wetlands associated with the construction of the building. If there are any
wetlands in the vicinity that are over one-third acre in size, then there must be a
50 foot setback. Please note that there are two criteria for determining the
presence of wetlands. Both Army Corps of Engineers and U.S. Fish and Wildlife
criteria must be used.
10. Please provide a letter regarding the investigation of Prebles Jumping Mouse and
Spiranthes (Ute Ladies Tresses Orchid). Please contact Kim Kreimeyer,
Department of Natural Resources, 221-6750, for information on existing mouse
trapping data along the Poudre River and the appropriate times of the year for
conducting these investigations.
ITEM: Boxelder Sanitation District Maintenance Building
MEETING DATE: October 16, 2000
APPLICANT: Boxelder Sanitation District c/o Mr. Greg Schmid, Schmid
Engineering, 1204 Lincoln Avenue, Loveland, CO. 80537.
LAND USE DATA: Request for 6,933 square foot building for shop, garage, repair and
storage located north of the Boxelder Sanitation District sewage treatment pond. The site
is approximately one-half mile south of Prospect Road and approximately 1,500 west of
the I-25 frontage road. There would be no additional employees associated with the new
building.
COMMENTS:
The site is located in the R-C; River Conservation zone district. The proposed
building would be classified as an accessory use and subject to the building
permit/utility plan review process. A public hearing would not be required.
2. The length of building, 106 feet, exceeds the maximum allowable length of 75
feet as specified in the R-C zone. A modification from this standard will not be
required as the intent of the standard is to preserve views of the Poudre River
from public spaces. Since there are no public views that will be blocked by the
building, and the building is set well back from the nearest public street (I-25
frontage road), this particular standard is considered to be not applicable.
3. Since the building is located within city limits, it must be served by the City of
Fort Collins Light and Power Department. The nearest existing electrical
facilities are located approximately one mile north or one mile west. Electrical
service would have to be extended to the building and placed within a six foot
wide easement. It may be possible to come down the frontage road within
existing right-of-way where an easement may not necessarily be required.
Trenching electrical service will cost approximately $15 - $20 per linear foot.
4. Since electrical service was formally provided by R.E.A., the "Service Rights
Fee" will apply. This fee is to compensate R.E.A. for loss of territory due to
annexation. The City has two years to serve the property. A surcharge of 5% of
the electric bill is charged to the customer which gets passed to R.E.A. for a
period of ten years. If electrical service was formally provided by Public Service
