RE: Garth Commercial Plaza Modification of Standards Approval
Dear Mr. Holter,
On Thursday, December 19, 2002, at the regular meeting of the City of Fort Collins
Planning and Zoning Board, the Board voted 7-0 to approve the requested Modification
of Standards for the Garth Commercial Plaza, File #20-02A. The approval is valid for a
period of one year from the date of approval.
In addition to the two modifications that were granted on May 16, 2002 [see file #20-02],
this approval allows you to deviate from the Land Use Code in one specific area. You
were granted approval to deviate from Section 3.5.3(B)(1) of the Land Use Code where
it specifies that main entries face and open directly onto a connecting walkway, without
requiring the pedestrian to cross a vehicular use area.
This approval allows the pedestrian connections between the building and the Mason
Street sidewalk to cross the vehicular drive in accordance with the diagram drawn by
Cityscape Urban Design titled "Exhibit 1: Proposed Plan with Modifications." A Project
Development Plan (P.D.P.) application is still necessary to conduct the detailed review of
the project if you intend to proceed. Such P.D.P. application will need to be submitted
within one calendar year from the date of the modification approval in order for the
modification to still be valid.
