RE: Garth Commercial Plaza Modification of Standards Approval
Dear Mr. Holler,
On Thursday, May 16, 2002, at the regular meeting of the City of Fort Collins Planning
and Zoning Board, the Board voted 5-1 to approve the requested Modification of
Standards for the Garth Commercial Plaza, File #20-02. The approval is valid for a
period of one year from the date of approval.
This approval allows you to deviate from the Land Use Code in two specific areas. First,
you are permitted to deviate from Section 3.5.3(B)(2) of the Land Use Code where it
specifies that no vehicle areas are allowed between the building and the street. Second,
you are permitted to deviate from Section 3.5.3(6)(2)(b) where it specifies that buildings
shall be located no more than 15 feet from the right of way of Mason Street.
This approval allows the building to be located on the site as shown on the document
titled "Plan A — Proposed Site Plan" with regard to parking lot location and setback. A
Project Development Plan (P.D.P.) application is still necessary to conduct the detailed
review of the project if you intend to proceed. Such P.D.P. application will need to be
submitted within one calendar year from the date of the modification approval.
