The area meets all criteria included in Colorado Revised Statutes to qualify for a voluntary annexation to the City of Fort Collins. 3. The requested zoning of Transition (T) is warranted by a change of conditions on the subject property as a direct result of the East Mulberry Corridor Plan currently under development. RECOMMENDATION: Staff recommends that the Planning and Zoning Board forward a recommendation to the City Council to approve the Whitham Farms Annexation with a zoning designation of Transition Zone District (T). Background: The property is located within the Fort Collins Growth Management Area (GMA). According to policies and agreements between the City of Fort Collins and Larimer County, contained in the Intergovernmental Agreement For The Fort Collins Growth Management Area, the City has agreed to pursue annexation of property within the GMA which is eligible for voluntary annexation according to Colorado Revised Statutes (CRS). The CRS requires 1/6 of the property to be contiguous with the existing City limits. As proposed, 2,642 feet of approximately 3,965 feet of the total property boundary is contiguous to the existing City limits. This exceeds the minimum 661 feet required to achieve 1/6 contiguity. This contiguity occurs through a common boundary with the property to the north, east and west of the parcel. The surrounding zoning and land uses as follows: N: T - agriculture S: I (Larimer County) — agriculture E: T — agriculture W: T - agriculture 2. Zoning and Analysis: The property is currently zoned Industrial (1) District in Larimer County. The City's adopted Structure Plan, a part of City Plan, designates the site as Low Density, Mixed -Use Residential. The City and Larimer County are currently developing a new land use plan for the East Mulberry Corridor. This property is included within the study area. The plan is currently within the development stages, and is not expected to begin the adoption phase until August of this year. As a result, staff is recommending this parcel be zoned T - Transition. The property must be rezoned in the future, consistent with the Structure Plan, prior to any development occurring on the property. 3. Whitham 0189 Arrowhead Bluff Road - BRR Silverthorne, CO 80498 PROJECT DESCRIPTION: The Whitham Farms Annexation is a request to annex and zone 20.04 acres of land located east of Timberline Road, between Vine Drive and Mulberry Street. The parcel is currently zoned Industrial in Larimer County. The property is currently used for agriculture and is vacant. The proposed zoning is T — Transition. RECOMMENDATION: Staff recommends approval of the annexation and recommends that the property be zoned T — Transition. EXECUTIVE SUMMARY: 1.
