The West 264 feet of Tract 7 of East Acres recorded May 19, 1930 as Reception No. 367765 of the
Records of Larimer County, located in the Northeast Quarter of the Northeast Quarter of Section
Twenty-four (24), Township Seven North (T.7N.), Range Sixty-nine West (R.69W.) of the Sixth
Principal Meridian (6th P.M.), City of Fort Collins, County of Larimer, State of Colorado, except
that portion described in instrument recorded December 20, 1979 in Book 2013 at Page 854.
Said described parcel of land contains 4.364 Acres, more or less.
***The portion of the West 264 feet of Tract 7 of East Acres described in Book 2013 at Page 854
calls for the Northerly low water line of Spring Creek as the Southerly boundary of that particular
parcel of land (Exception Parcel). This is a Riparian Boundary and subject to slow and
imperceptible movement and as such is ambulatory in nature. The low water mark has been defined
in the 1973 Manual of Surveying Instructions as "the point to which a river or other body of water
recedes, under ordinary conditions, at its lowest stage". To survey and establish the Northerly
boundary of the Subject Parcel as of the date of this survey, the points where the edge of water
meets the toe of the Northerly bank of the creek have been located. A meander line has been
established in conjunction with this survey to reference several points along the watercourse and
aid in the future retracement of the watercourse boundary as being depicted by this survey.
Colorado Board Rule for Surveyors 6.5.4.1 (Monumentation of Natural Water Boundaries) state
this: A stream, creek, river, or shoreline is itself a natural monument. The surveyor must conduct
research to determine if the stream, or any part thereof, is the intended boundary line. The
acceptance of the stream, creek, river, or shoreline as a natural monument complies with Section
38-51-104 (1)(a), C.R.S. Where a riparian boundary is described as the thread of a non -navigable
stream or to some water boundary, no further artificial monumentation is required.
