Topic: ROW dedication/vacations

It is important to note that when the property owner is giving land to the City, it is a ROW dedication.
When the City is giving land to the private property owner, it is a ROW vacation. ROW and does not
need to be vacated from the frontage road to College Avenue. The ROW being vacated is City -
owned, and the remainder of the frontage road ROW will continue to be City -owned, not State-owned
like the main portion of College Avenue.

Staff has reviewed your submittal for DISCOUNT TIRE AT FOSSIL CREEK, and we offer the
following comments:

[6/25/021 Provide a material board including color samples. I'm wanting to ensure the colors are
compatable with the neighborhood as required in 3.5.1(F) of the LUC. Specifically, "banner red,"
"burgundy," and "main harbor" are extremely difficult to estimate without a sample.
[9/25/021 Repeat comment. Although the color computer rendering is helpful, actual samples of the
color are still necessary.
[2/19/02] Thank you for the color samples. After review of the samples, it has become apparent that
"banner red" is too intense to satisfy the language of 3.5.1(F) of the LUC which states, "Color shades
shall be used to facilitate blending into the neighborhood and unifying the development. The color
shades of building materials shall draw from the range of color shades that already exist on the block
or in the adjacent neighborhood." Replace all locations where "banner red" is specified with "classic
burgundy." Please note in section 3.5.3(D)(1) of the LUC that "a standard prototype design shall be
modified if necessary to meet the provisions of this LUC."
[6/11/03] The colored artist renderings reflect an acceptable color scheme. The elevations, however,
were not revised to reflect those changes. Ensure that the roofs are shown on the revised elevations
to be teal, not banner red. Also, ensure that the elevations clarify that the stripe around the building is
not banner red, but rather burgundy. The banner red is only appropriate on the letters of the sign and
the aluminum store front as shown on the rendering. We suggest (however do not require) that the
width of the horizontal burgundy stripe be narrowed.

The off -site easement's letter of intent from the adjacent Home Owner's Association needs to be in a
letter format, written to the City of Fort Collins, and signed by a person who is identified as
representative of the HOA. Coordinate this with Katie Moore from Engineering.

The project is ready for hearing. The labels we have on file are more than 6 months old, so we need
updated mailing labels. As soon as we receive the letter of intent to grant the easemnt from the
adjacent HOA, we can conduct the public hearing. Tentatively, Wednesday July 2nd is the hearing
date, however have to mail the notice out 2 week prior to the hearing. We need the new labels and
letter of intent before we can mail out the notice, which must go in the mail by June 18th in order to
make the July 2nd hearing date.
