Please note that both the H-C and B-C zones had substantially the same stated purpose and allow substantially similar uses. City Plan The City Structure Plan adopted in 1997 identifies all of the properties with North College Avenue frontage, from Vine Street north all the way to the intersection of North College Avenue and Shields Street, as being within a commercial district. Although the majority of the corridor was designated Commercial Corridor, the northeast corner of North College Avenue and Willox Lane was designated Community Commercial. This is the only stretch of North College Avenue frontage with a different Structure Plan designation, sandwiched between stretches of Commercial Corridor property. Thereafter, all of the Commercial Corridor properties within the City limits were rezoned to the Commercial - North College District (C-N) and the Community Commercial properties were rezoned to the Community Commercial - North College District (C-C-N). Please note that the current zoning designations are very similar to the preceding H-C and B-C zoning designations in purpose and permitted uses. The notable difference, however, is that the C-C-N zone very clearly prevents the location of a supermarket. Rezoning Criteria LUC Section 2.9.4.(H)(2)(a) - The proposal to rezone Tracts A, B and C from C-C-N to C-N is consistent with its identification as part of a commercial district on the City's Structure Plan. Although the properties are specifically designated as a Community Commercial District, the appropriateness of this designation, as opposed to Commercial Corridor is questionable, because of the overwhelming similarities in the location and characteristics of the properties. LUC Section 2.9.4.(H)(3)(a) and (c) - Despite the different zoning designations, the properties at the northeast corner of North College Avenue and Willox Lane, have characteristics similar to properties in the near vicinity, particularly the commercial center immediately to the south, and are perhaps even more suited to the C-N zoning. The properties are immediately adjacent to a high traffic commercial corridor, which is also a State highway and major City arterial, and at the intersection of this corridor and another arterial street. There is existing medium density residential development to the east, to provide a transition between intense commercial uses and less dense neighborhoods farther to the east. There is also an existing natural barrier, the Eaton Ditch, to aid in the transition from commercial to residential. For all of these reasons, the proposed zoning designation is compatible with the surrounding existing and proposed uses, is the appropriate zone district and would result in a logical and orderly development pattern. LUC Section 2.9.4.(H)(3)(b) - Development of the property in compliance with the applicable requirements of the Land Use Code will ensure protection from significant adverse impacts to the natural environment and the natural functioning of the environment. Exhibit D Justification for Rezoning Petition The three tracts subject to this Rezoning Petition are contiguous vacant parcels located in an area that is bounded on the west by College Avenue, on the south by Willox Lane, on the north by the Eaton Ditch, and on the east by the Eaton Ditch and a -commercially-zoned County parcel. The entire north and east boundary of the three contiguous tracts subject to this Rezoning Petition is the edge of the City limits. The three tracts comprise the majority of the property in this area; the balance of the area is comprised of small businesses oriented to College Avenue or residential, primarily mobile homes. The current zoning designation for all of the properties is Community Commercial - North College District (C-C-N). Although the actual use of the properties in this area has not changed significantly over the last decade, the zoning designations have changed twice, first as a part of the implementation of the North College Avenue Corridor Plan, and most recently as a part of the comprehensive rezoning done in conjunction with the adoption of City Plan. North College Avenue Corridor Plan When work on the North College Avenue Corridor Plan ("Corridor Plan") began in 1992, Tract A was in the I-L Limited Industrial District. Tracts B and C were in the H-B Highway Business District, as were all of the properties in the study area with North College Avenue frontage. Following adoption of the Corridor Plan as an element of the City's Comprehensive Plan in 1995, a vast majority of the properties in the Corridor Plan study area with North College Avenue frontage were rezoned to a new zoning district - the H-C Highway Commercial District. The H-C zone was described in Section 29 of the City Code (now the Transitional Land Use Regulations) as being "forhigh traffic commercial corridors where a range of uses is encouraged to create a transition from commercial operations on a highway, major arterial street or rail spur, to-, less intrusive areas orresidential neighborhoods." Permitted uses in the H-C zone included a wide variety of permitted industrial, business, commercial and retail uses, shopping centers and mixed use developments. In the comprehensive rezoning of the North College Avenue frontage properties, all areas were zoned H-C except the area northeast of the North College Avenue/Willox Lane intersection, which includes Tracts A, B and C, the properties subject of this Rezoning Petition. Although these tracts and the small businesses and residential properties in the area northeast of the North College Avenue/Willox Lane intersection had substantially similar characteristics as the H-C zoned properties (on North College Avenue and immediately adjacent to the H-C zone), they were rezoned to a different new zoning designation - the B-C Business Center District. The Corridor Plan states that the Business Center District "has the potential for some of the highest commercial intensities ..., as well as the greatest mix of shopping, jobs and housing within walking distance of transit." Section 29 of the City Code stated the purpose of the B-C zone as being EXHIBIT C Legal Description of Tract C A parcel of Land located in Section 36, Township 8 North, Range 69 West of the 6th P.M. in the City of Fort Collins, County of Larimer, State of Colorado, Said Parcel of land being a portion of the SW 1/4 of the SW 1/4 of said section 36 and a portion of tract P of replat No. 1 of Evergreen Park, Said parcel of land described as follows: Beginning at a point on the South line of the SW 1/4 of the SW 1/4 of Section 36, township 8 North, Range 69 West, of the 6th P.M., 275 feet East of the SW Corner of Said Section; Thence North 182 Feet; Thence West 85 Feet; Thence North 148 Feet; Thence East 1130 Feet, more or less, to the East Line of Said SW 1/4 of SW 1/4; Thence South 330 feet to the SE Corner of Said SW 1/4 of SW 1/4; Thence West 1045 Feet more or less to the point of beginning; except that a portion as dedicated for street purposes in Book 1285 at Page 275 and as dedicated on the Plat of Replat No. 1 of Evergreen Park. Tract C is 8.2 acres, more or less, and is referred to as Parcel No. 98363-00-023.
