Felix,
After reviewing all the history of this situation, we keep coming back to the same place we were with Gary
over a year ago. That is, there is an existing zoning violation in the form of the driveway to a commercial
establishment that goes thru the LIE District. Engineering has no problem with this driveway, and it serves
the access needs for Gerrard's property just fine. However, the zoning requirement could not be waived,
varied or modified; so the "solution" that was decided upon was to plat the unplatted property, with the
driveway being dedicated as a public street. I thought we had almost reached agreement with Gary last
year on the platting requirements, but he discontinued his efforts on this and the project expired. Since
then, the only thing that has happened was the snowstorm.
It seems to me that Gary still needs to go thru the PDP process and plat this property, but now to get a
building permit, in addition to correcting the zoning violation with his driveway. It is my understanding that
this project never went to hearing, and expired due to lack of responses to staff comments. Now, I can't
waive the platting requirements of LUC 3.3.1 even if I want to. It can only be modified by the CPES
Director or the P&Z, according to the LUC. Paul Eckman confirmed that for me. We will be glad to pick
up the PDP process where it left off, and move forward if Gary will go ahead and complete that process.
He could even request a modification to allow him to be exempt from the platting requirement in order to
replace the mobile home on that site. But all of that would have to be decided in CPES.

Gary Gerrard and son Nathan met with Peter Barnes and me Friday 5/28 to discuss placing a new
dwelling unit on the property (formerly belonging to Les Kaplan), replacing a mobile home that was
removed some time ago. Gary is requesting that given the mobile home pre-existed annexation, he be
allowed to replace it without platting because of concessions he allegedly made to City. He also left a
copy of a proposed draft development agreement he said was submitted to Eng. on 9-10-03, and to which
he says there has not yet been a response. Gary indicated you are all quite familiar with the issues.
In any case, this seems to be an Engineering service request to start with. So, I'll forward copies of their
earlier proposed development agreement. He appreciated our cooperation in being able to repair the
structural roof damage to his warehouse from last year's big snow.
