I have received your letter dated October 14, 2002. We are somewhat confused as to why the
dedication we submitted is not acceptable. All of the information has been included that City
Staff has requested. There was no indication after our initial submittal that the easement
dedication would not be acceptable. In fact, the information we used to draft the easement
dedication was given to us by your office. This included a form for a "Deed of Dedication For
Right -Of -Way", a form for a "Deed of Dedication For Easement", an instruction sheet labeled
"Easement and Right -Of -Way Dedications", and an Application for a driveway. The
dedication was carefully compiled using this information.
Again, I would like to remind you that we do not want to develop at this time. We are simply
trying to dedicate a roadway that already exists on our property under direction given by the
City. We understand that we may have to dedicate utility easements and install curb, gutter,
sidewalk, and pavement when and if we develop the property.
Prior to submitting any further documents, we would like an explanation of what exactly the
City Code requires us to submit and how this will resolve any issues that the City has with this
dedication. We have submitted precisely what was previously requested. What exactly about
the proposed easement is not acceptable? Please refer to the section(s) of City Code that apply.
