That portion of the Southeast Quarter of Section 31, Township 7 North, Range 68 West
of the 6 h P.M., County of Larimer, State of Colorado, which, considering the East line of
said Southeast Quarter as bearing N 00°12' W, and with all bearings contained herein
relative thereto, is more particularly described by the following boundary lines:
Commencing at the Southeast Corner of said Section 31; thence N 009 2' W 925.86 feet;
thence N 90°00'00"W 61.88 feet to the POINT OF BEGINNING; thence N 90°00'00"W

line of said Southeast i/4 as bearing North 00' 12' West and with all bearings contained
herein relative thereto is contained within the boundary lines which begin at a point
which bears North 00°12' West 779.38 feet from the Southeast corner of said Section 31,
and run thence North 00° 12' West 156.48 feet; thence West 835.12 feet to a point in the
Easterly right-of-way line of the Union Pacific Road; thence South 00°13' East 156.48

DEED OF DEDICATION FOR EASEMENT
KNOW ALL MEN BY THESE PRESENTS: That the undersigned, Gary M.
Gerrard and Mary E. Gerrard, being the owners of certain real property in Larimer County,
Colorado legally described on Exhibit A attached hereto, in consideration of Ten Dollars
($10.00) in hand paid, receipt of which is hereby acknowledged, and other good and valuable
consideration, does hereby dedicate, transfer, and convey to the City of Fort Collins, Colorado, a
Municipal Corporation, for public use forever a non-exclusive permanent easement for access in
the City of Fort Collins, County of Larimer, State of Colorado, more particularly described as
follows:
That portion of the Southeast Quarter of Section 31, Township 7 North, Range 68 West of the 6"'
P.M., County of Larimer, State of Colorado, which, considering the East line of said Southeast
Quarter as bearing N 00'12' W, and with all bearings contained herein relative thereto, is more
particularly described by the following boundary lines:
Commencing at the Southeast Corner of said Section 31; thence N 00012' W 925.96 feet; thence
N 90000'00"W 63.25 feet to the POINT OF BEGINNING, thence N 90°00'00"W 773.23 feet;
thence S 0093'00" E 51.00 feet, thence S 90°00'00" E 772.77 feet; thence N 00°18'13" E 51.00
feet, more or less to the POINT OF BEGINNING, containing 39,423 square feet, more or less,

Collins will not accept the duty of maintenance of such easement.

RE: Gerrard Roadway Dedication
In response to your comments dated August 7, 2002 regarding the Gerrard Roadway
Dedication at 4409 Timberline, please review the following;
Engineering
We have already offered to grant a utility easement to the City and were rejected. We do not
understand why a utility easement is necessary at this time, we are only building a driveway.
There is no development.
The dedication statement has been modified as per request by the City Attorney's office. The
revised statement is included with this letter.
A picture exhibit of the easement dedication was previously submitted. An additional copy is
included with this letter.
Water Wastewater
We will build a private drive at the risk of tearing it up in the future to install utilities when
development occurs.
Zoning
Please refer to the Description of Easement to be Dedicated on the plan sheet. It contains a
legal description of the easement and a map of the dedication within the context of the
property owned. The plan sheet includes all of the items you requested including the zoning of
adjacent properties.
