FINDINGS OF FACT/CONCLUSION:
The annexation of this area is consistent with the policies and agreements between
Larimer County and the City of Fort Collins as contained in the Intergovernmental
Agreement for the Fort Collins Urban Growth Area.
2. The area meets all criteria included in Colorado Revised Statutes to qualify for a
voluntary annexation to the City of Fort Collins.
3. The requested zoning of Low Density Mixed Use Residential (LMN) is warranted by the
designation on the City of Fort Collins Structure Plan.
RECOMMENDATION:
Staff recommends that the Planning and Zoning Board forward a recommendation to the
City Council to approve the First Free Will Baptist Church Annexation with a zoning
designation of Low density Mixed Use Residential Zone District (LMN).

FINDINGS and ANALYSIS:
1. Background:
The property is located, within the Fort Collins Growth Management Area (GMA).
According to policies and agreements between the City of Fort Collins and Larimer County,
contained in the Intergovernmental Agreement For The Fort Collins Growth Management
Area, the City has agreed to pursue annexation of property within the GMA which is
eligible for voluntary annexation according to Colorado Revised Statutes (CRS). The CRS
requires 1/6 of the property to be contiguous with the existing City limits. As proposed, 914
feet of approximately 1,827 feet of the total property boundary is contiguous to the existing
City limits. This exceeds the minimum 305 feet required to achieve 1/6 contiguity. This
contiguity occurs through a common boundary with the property. to the east and south
(across Trilby Road) of the parcel.
The surrounding zoning and land uses are as follows:
N: FA (Larimer County) — Single Family Residential
S: RL — Single Family Residential
E: NC — undeveloped
W: MMN — Multi -Family Residential
2. Zoning and Analysis:
The property is currently zoned Residential (R2) District in Larimer County. The City's
adopted Structure Plan, a part of City Plan, designates the site as Low Density, Mixed -Use
Residential.
The use of a church or other religious facility is permitted within the LMN zone district as
an Administrative (Type 1) Review. The church use will be conforming to the use
requirements within the LMN zone district, however, the site does not conform to the site
planning requirements within Chapter 3 of the Land Use Code. The most noted
deficiencies include the parking area in front of the facility, lack of landscaping on the site
and the sub -standard street improvements and sidewalk adjacent to this site. The site is
also included within the 1,320 foot buffer area surrounding the Ferruginous and Red -Tail
Hawk roosting sites on the adjacent Timan property. A modification from this buffer
requirement will need to be granted as part of a development application to expand or
redevelop this site.

PROJECT DESCRIPTION:
The First Free Will Baptist Church Annexation is a request to annex and zone 4.92 acres
of land located west of College Avenue and north of Trilby Road. The First Free Will
Baptist Church has an existing church at this location. This church is around 3,300 sq.ft. in
size, and with the associated parking and other outbuildings occupies, around 1/3 of the
site. The parcel is currently zoned R2 Residential in Larimer County.
The proposed zoning is LMN — Low Density Mixed -Use Neighborhood.
RECOMMENDATION: Staff recommends approval of the annexation and recommends
that the property be zoned LMN — Low Density Mixed -Use Neighborhood.
EXECUTIVE SUMMARY:
