HomeMy WebLinkAboutLAKE SHERWOOD WTE - PDP - 40-02 - REPORTS - RECOMMENDATION/REPORTLake Sherwood, Wireless Telecommunications Equipment, #40-02 Type II Planning and Zoning Board Review Page 4 FINDINGS OF FACT/CONCLUSIONS After reviewing the Lake Sherwood Wireless Telecommunication Equipment Project Development Plan, #40-02, staff makes the following findings of fact and conclusions: 1. The proposed land uses are permitted in the Low -Density Residential district. 2. The Project Development Plan complies with all applicable district standards of Section 4.3 of the Land Use Code, Low -Density Residential zone district. 3. The Project Development Plan complies with all applicable General Development Standards contained in Article 3 of the Land Use Code. RECOMMENDATION: Staff recommends approval of Lake Sherwood Wireless Telecommunication Equipment Project Development Plan, #40-02 Lake Sherwood, Wireless Telecommunications Equipment, #40-02 Type II Planning and Zoning Board Review Page 3 prevent future telecommunication carriers from co -locating upon this structure. All parties involved must negotiate in good faith to achieve co -location of telecommunication equipment on existing structures. Setbacks — The ground equipment will be 10 feet from the Parklane Drive Curb. Since this is not a structure, it is not subject to the setback criteria within Sections 4.3 or 3.5.3 of the land use code. The proposed City of Fort Collins recreation trail is located five feet behind the enclosure (29 feet behind the curb). Wireless Telecommunication Equipment — The antenna equipment will have the same finish as the existing utility pole. Landscaping and Fencing — The equipment enclosure will be located behind an existing tree and shrub border which is planted adjacent to Parkland Drive. This existing vegetation will provide screening of the facility from the adjacent Parkland Drive and residential west of the site. Additional landscaping will be included along the south of the shelter to provide additional screening to the future recreation trail. Since the facility is located under an electric transmission line, the height and type of vegetation is limited. A six- foot cedar fence will enclose the ground -mounted equipment. Lighting — The only lighting associated with the project is service lighting which will be included within the equipment enclosure. This lighting would only be used for services performed when it is dark. Historic Sites and Structures — The wireless telecommunication equipment is not located on a historic structure, nor is the site located within a historic district. Stealth Technology — The wireless telecommunication equipment is located on an existing metal electric utility pole. The poles themselves are not considered an attractive asset to the neighborhood, and is strictly a utility function. The antenna design will not further detract from the utility nature of the poles themselves. The antennas have been designed to minimize the appearance, based on their location. 4. Neighborhood Information Meeting Based on the nature and the materials presented as part of the project submittal, and the limited impacts on adjacent property owners, a neighborhood meeting was not held for this application. Lake Sherwood, Wireless Telecommunications Equipmem, #40-02 Type II Planning and Zoning Board Review Page 2 EXECUTIVE SUMMARY: The project development plan has been reviewed in accordance with the applicable requirements of the Land Use Code (LUC) and was found to be in substantial compliance with the following: The process located in Division 2.1 — General Procedural Requirements, Division 2.2 — Common Development Review Procedures for Development Applications, and Division 2.4 — Project Development Plan located within Article 2 — Administration; and the design standards located within Article 3 — General Development Standards; and the standards located in Section 4.3, Low Density Residential (RL) of Article 4 — Districts. ANALYSIS: 1. Background The surrounding zoning and land uses are as follows: N: RL — Railroad Right -of -Way S: RL — Railroad Right -of -Way E: RL — Railroad Right -of -Way, Single -Family Residential W: RL — Parkland Drive, Single Family Residential The property was annexed in June, 1977 as part of the Greenwalt 10th Annexation. 2. Division 4.3 of the Land Use Code, Low Density Residential District The proposed use of wireless telecommunication equipment is permitted in the Low -Density Residential zone district subject to Planning and Zoning Board review. 3. Division 3.8, Supplemental Regulations A. Section 3.8.13, Wireless Telecommunication Location — The wireless telecommunication equipment is proposed to be located on an existing non-residential structure within the Low -Density Residential zone district. Co -location — There are no other existing wireless telecommunication facilities or equipment within the general area which the applicant may co -locate upon. The applicant may not ITEM NO. 4 7 MEETING DATE 2/6 03 STAFF Bob Barkeen Citv of Fort Collins PLANNING AND ZONING BOARD STAFF REPORT PROJECT: Lake Sherwood — Wireless Telecommunication Equipment, Project Development Plan - #40-02 [Type II Planning and Zoning Board Review] APPLICANT: Starbridge Communications 4255 Kittridge Street, Suite #1888 Denver, CO 80239 OWNER: Union Pacific Railroad 1416 Dodge Street, PF003 Omaha, NE 68179 PROJECT DESCRIPTION: Lake Sherwood is a project development plan for a wireless telecommunication antenna to be located on the top of an existing 90-foot electric transmission pole. The pole is located within the Union Pacific Railroad Right of Way, between the railroad tracks and Parkland Drive, just north of Lake Shore Circle. The pole is a part of the Platte River Power Authority electric transmission line which parallels the Union Pacific Railroad. The antenna array will consist of six individual antennas, located in three groups of two. The groups will be spaced about 6 feet apart. The support equipment will be located about 50 feet south of the pole. The equipment will be concealed within a 21 feet by 14 feet fenced area. The enclosure will be located ten feet from the curb on Parklane Drive, immediately behind an existing row of shrubs. These shrubs will remain and provide additional screening for the equipment enclosure. The property is zoned RL — Low Density Residential.
