FINDINGS OF FACT/CONCLUSIONS
After reviewing the 2420 Laporte Avenue Wireless Telecommunication
Equipment Project Development Plan, #48-02, staff makes the following findings
of fact and conclusions:
1. The proposed land uses are permitted in the Low Density Mixed -Use
Neighborhood district.
2. The Project Development Plan complies with all applicable district
standards of Section 4.4 of the Land Use Code, Low -Density Mixed -
Use Neighborhood district.
3. The Project Development Plan complies with all applicable General
Development Standards contained in Article 3 of the Land Use Code.
RECOMMENDATION:
Staff recommends approval of 2420 Laporte Avenue Wireless
Telecommunication Equipment Project Development Plan, #48-02

initially tried to locate the equipment on this facility, however, the
school district has a moratorium on wireless equipment. The
applicant may not prevent future telecommunication carriers from
co -locating upon this structure. All parties involved must negotiate
in good faith to achieve co -location of telecommunication
equipment on existing structures.
Setbacks — The addition to the church to accommodate the steeple
is beyond the minimum 15-foot setback required for non-residential
structures within the LMN zone district. The shed enclosing the
ground equipment is beyond this setback as well.
Wireless Telecommunication Equipment — The steeple enclosure
and base will be the same color and material of the existing church.
The proposed steeple will be the same color as the trim of the
building, and the base will use the same brick color as the existing
building. Since the equipment is enclosed within the structure, It is
not subject to the 15-foot maximum height limitation to equipment
mounted on the roof of a building.
Landscaping and Fencing — The equipment enclosure will be
landscaped to soften its appearance. The equipment enclosure is
located behind the church, and will not be readily visible from
Laporte Avenue. Additional landscaping will be provided to soften
the appearance of the enclosure structure.
Lighting — No additional lighting for the equipment is proposed with
this application.
Historic Sites and Structures — The wireless telecommunication
equipment is not located on a historic structure, nor is the site
located within a historic district.
Stealth Technology — The wireless telecommunication equipment is
included within a church steeple, specifically designed to
accommodate the equipment. The steeple will match the
architecture of the existing church, and is an ideal proposal to
conceal the equipment.
4. Neighborhood Information Meeting
Based on the nature and the materials presented as part of the
project submittal, and the limited impacts on adjacent property
owners, a neighborhood meeting was not held for this application.

EXECUTIVE SUMMARY:
The project development plan has been reviewed in accordance with the
applicable requirements of the Land Use Code (LUC) and was found to be in
substantial compliance with the following:
The process located in Division 2.1 — General Procedural Requirements, Division
2.2 — Common Development Review Procedures for Development Applications,
and Division 2.4 — Project Development Plan located within Article 2 —
Administration; and the design standards located within Article 3 — General
Development Standards; and the standards located in Section 4.4, Low Density
Mixed Use Neighborhood (LMN) of Article 4 — Districts.
ANALYSIS:
1. Background
The surrounding zoning and land uses are as follows:
N: LMN — Undeveloped
S: RL — Poudre High School
E: LMN — Single -Family Residential
W: LMN — Single Family Residential
The property was annexed in September 1982 as part of the Vine —
Laporte/Taft Annexation.
2. Division 4.4 of the Land Use Code, Low Density Mixed Use Residential
District
The proposed use of wireless telecommunication equipment is permitted
in the Low Density Mixed -Use Residential zone district subject to Planning
and Zoning Board review.
3. Division 3.8, Supplemental Regulations
A. Section 3.8.13, Wireless Telecommunication
Location The wireless telecommunication equipment is proposed
to be located on an existing non-residential structure within the Low
Density Mixed -Use Neighborhood zone district.
Co -location — The only other suitable location for the antenna is the
existing facility at the Poudre High School. The applicant had

PROJECT DESCRIPTION:
2420 Laporte Avenue is a project development plan for a wireless
telecommunication antenna to be located within a steeple tower on the Calvary
Baptist Church. The development plan includes the addition of the steeple, which
would be built on the front of the church. The steeple would have a total height of
78' 6". The existing church has a height of 38 feet. The steeple design and
addition is complimentary to the existing building. The equipment will be
concealed within a 26 feet by 12 feet structure which will be located behind the
church.
The property is zoned LMN — Low Density Mixed Use Neighborhood.
RECOMMENDATION:
