RECOMMENDATION:
Staff recommends that the Planning and Zoning Board forward a recommendation to the
City Council to approve the Streamside Annexation and Zoning, File # 55-02 with a zoning
designation of Urban Estate (UE).

2. Zoning and Analysis:
The property is currently zoned FA1 - Farming in Larimer County. The requested zoning
for this annexation is the Urban Estate District (LIE). On the City's adopted Structure Plan,
a part of City Plan, the site is designated "Rural /Open Lands and Stream Corridors," and
identified as part of the 1-25 Special Study Corridor. The effort to develop an 1-25 Corridor
Subarea Plan is currently in progress. As part of the 1-25 Subarea planning effort, the site
is recommended to be designated as UE when that plan goes to final hearings, therefore a
zoning designation of UE is consistent with the Structure Plan. UE zoning is consistent
with the Streamside Planned Land Division (PLD), which is a County development
application, currently under review, that encompasses the site. Annexation of this property
will allow the building permits to be issued under the City's jurisdiction. During the review
of the County development application for Streamside PLD, City staff worked closely with
the applicant to ensure that the application would be developed in accordance with the
City's floodplain regulations for the Boxelder floodplain. Annexation of the Streamside
PLD prior to the issuance of building permits gives the City the authority to enforce the
County's development approval, in particular, the adherence to the applicable floodplain
regulations.

FINDINGS OF FACT/CONCLUSION:
1. The annexation of this area is consistent with the policies and agreements between
Larimer County and the City of Fort Collins as contained in the Intergovernmental
Agreement for the Fort Collins Growth Management Area.
2. The area meets all criteria included in Colorado Revised Statutes to qualify for a
voluntary annexation to the City of Fort Collins.
3. The requested Urban Estate (UE) is in conformance with the policies of City Plan and is
consistent with the Structure Plan.

PROJECT DESCRIPTION: This is a request to annex approximately 73.67 acres, located
just over half a mile east of 1-25 and south of Vine Drive.
RECOMMENDATION: Staff recommends approval of the annexation and recommends
that the property be placed in the Urban Estate (UE) zone district.
EXECUTIVE SUMMARY:
1. The annexation of this area is consistent with the policies and agreements between
Larimer County and the City of Fort Collins as contained in the Intergovernmental
Agreement for the Fort Collins Growth Management Area.
2. The area meets all criteria included in Colorado Revised Statutes to qualify for a
voluntary annexation to the City of Fort Collins.
3. The requested Urban Estate (UE) zone districtis in conformance with the policies of
City Plan and is consistent with the Structure Plan.
COMMENTS:
1. Background:
The property is located within the Fort Collins Growth Management Area (GMA).
According to policies and agreements between the City of Fort Collins and Larimer County,
contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS
GROWTH MANAGEMENT AREA, the City will consider annexation of property within the
GMA when the property is eligible for annexation according to Colorado Revised Statutes
(CRS). This property is eligible for annexation according to CRS, requiring 1/6 contiguity
to the existing city limits. Streamside Annexation and Zoning complies with this standard
since the property has 2869.70 feet of its total boundary of approximately 13,742.27 feet
contiguous to the existing City limits. This meets the minimum 2290.38 feet required to
achieve 1/6 contiguity. This contiguity occurs through a common boundary with the
Peterson Annexation, which is under review and will be processed simultaneously with this
Streamside Annexation.
