Findings of Fact/Conclusion: A. The Balzers Subdivision meets the procedural requirements located in Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development Review Procedures for Development Applications, and Section 2.4 - Project Development Plan located in Article 2 - Administration. B. The Balzers Subdivision meets the plat requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards. RECOMMENDATION: Staff recommends approval of the Balzers Subdivision (being a replat of portions of Lot 9 & 10. Block 4, Westlawn Addition) - PDP - #51-02. The subdivision plat is in compliance with Section 3.3.1(A) General Provisions in that: 1) The subdivision plat will be filed and recorded only after having been approved by the Director of Planning, with such approval evidenced in writing on the plat and signed by the City Clerk. 2) No building permit or certificate of occupancy shall be issued for construction of any new principal building or no act which changes the use of any building shall be permitted until the subdivision plat is filed and recorded in the City of Fort Collins. B. The subdivision plat is in compliance with Section 3.3.1(B) Lots in that: 1) The two lots are at least 5,000 square feet in size (for single family and two-family dwellings), as set forth in Division 4.7 NCM — Neighborhood Conservation, Medium Density Zoning District, each lot has direct vehicular access to a public street or public alley (South Loomis Street for Lot 2, the alley for Lot 1), and the side lot lines are substantially at right angles or radial to the street and alley lines. 2) The general layout of lots, roads, driveways, utilities, drainage facilities and other services within the proposed development have been previously established in this Old Town neighborhood. C. The subdivision plat is in compliance with Section 3.3.1(C) Public Sites, Reservations and Dedications in that: 1) An applicant shall be required to dedicate rights -of way for public streets, drainage easements and utility easements as needed to serve the area being platted. The rights -of -way for South Loomis Street and the alley were previously dedicated with the Westlawn Addition subdivision plat and the drainage and utility easements necessary to serve these two lots will be dedicated with the Balzers Subdivision, if approved and filed. 2) Reservation of sites for flood control, open space and other municipal uses shall be made in accordance with the requirements of this Land Use Code. This criteria is not applicable to the Balzers Subdivision request. Balzers Subdivision - #51-02 April 24, 2003 Administrative Hearing Page 2 COMMENTS: 1. Background: The surrounding zoning and land uses are as follows: N: NCM; existing single family residential S: NCM; existing single family residential W: NCM; existing single family residential E: NCL; existing single family residential This property was annexed into the City, by resolution, as part of the Westlawn Addition in May, 1920. The property was subdivided as Lots 9 & 10, Block 4 of the Westlawn Addition Subdivision in May, 1920. 2. Purpose of the Subdivision: The purpose for the Balzers Subdivision is to create 2 legally subdivided lots on portions of properties that presently are two lots. The replat will create 2 lots, with the one fronting on South Loomis Street (Lot 2) being 7,802 square feet in size and the one fronting on an alley (Lot 1) being 5,308 square feet in size. The expressed intent of the applicant is to construct an alley house on Lot 1 at some time in the future; however, no site layout or building plans for a new structure are being reviewed at this time. The existing single family residence will remain on Lot 2. Staff has determined that there is no detriment to the development plan associated with the platting of the two lots. 3. Article 2 - Administration: The Balzers Subdivision complies with the applicable requirements of the LUC, specifically the procedural requirements located in Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development Review Procedures for Development Applications, and Section 2.4 - Project Development Plan located in Article 2 - Administration. 4. Article 3 - General Development Standards: The Balzers Subdivision complies with the applicable requirements of the LUC, specifically the plat requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards. Lot 1 would be 5,308 square feet in size and Lot 2 would be 7,802 square feet in size. There is one existing single family residence on the property, which is addressed as 624 South Loomis Street. It is located on the east side of South Loomis Street, south of West Myrtle Street, north of West Laurel Street, and west of South Whitcomb Street. The property is in the NCM — Neighborhood Conservation, Medium Density Zoning District. RECOMMENDATION: Approval EXECUTIVE SUMMARY: This request to create a 2-lot subdivision plat for portions of properties that presently are two lots in the Westlawn Addition subdivision.
