Hello Cameron:
It's 2:00 a.m. Sunday, April 27. 1 have just finished calling the police and
determining the location of a party which is at 712 W. Laurel. This is a
location of a party I reported one week ago and according to the police
report they were ticketed last week.
I attended the administrative hearing of Thursday, April 24, regarding the
Balzers Subdivision which you conducted. This brings me to the point which
stressed at the meeting; the chronic disruptive noise which is not compatible
to residential living.
Obviously, the back houses and rental properties which the Balzers are
proposing will bring more students to the area. You might remember the
almost verbatim quote by Mr. Balzer referring to college students -- "that is
the type of people who will be renting."
In context, his statement appeared to me as in reality unconcerned because
he stated such a problem is greater issue of the city and not an issue for
him to solve. Technically, that is correct, but he is contributing to the
situation in this area, but doesn't have to experience the consequences of
his student housing expansion.
Although I appreciate the city providing a forum for such issues to be
discussed on April 24, 1 have some direct questions for you since you will be
rendering a decision.
1. Do you have any legal right to prevent the subdivision of 624 S. Loomis?
2. If not, then what is the purpose of such a hearing?
The concerned citizens who attended the meeting will not be satisfied with
"expressing their feelings." That would be a futile waste of our time if the
input does not actually influence the decision because legally it is
irrelevant.
By the way, one of the ladies who lives diagonal to the party via her back
yard (643 S. Loomis Av. I believe & who attended the meeting, but at this
time of the morning I can't think of her name) and attended the hearing of
April 24 told me she often moves from one part of the house to the other or
the basement to avoid noise. But then she is in upper 70's and often does
not have the energy to fight for her serenity. Somebody needs to assist
these people from being pushed out of the neighborhood.
And also, the previous owner of 624 L. Loomis, Charles Smith, an older
retired college professor and his wife were intimidated to call about the
noise. It is one of the reasons he moved out of the area.
