The project development plan complies with all applicable sections of Article 3 of
the Land Use Code, including the plat standards of Section 33.1. No evidence
was presented to contradict the statements and conclusions of the staff report
concerning compliance or to otherwise refute the compliance with the Article 3
Standards.
SUMMARY OF CONCLUSIONS
A. The Cambridge House Apartments Project Development Plan is subject to
administrative review and the requirements of the Land Use Code (LUC).
B. The Cambridge House Apartments Project Development Plan satisfies the
development standards of the CC zoning district.
C. The Cambridge House Apartments Project Development Plan complies with all
applicable General Development Standards contained in Article 3 of the Land
Use Code.
nFCISION
The Cambridge Lofts Apartments Project Development Plan #6-03C, is hereby
approved by the Hearing Officer with the following conditions:
1. The Applicant shall reserve, for future dedication to the City, eighteen (18) feet of
right-of-way for Plum Street.
2. The Applicant shall dedicate to the City, at no cost, an emergency access easement
in a location satisfactory to the Fire Marshall.
Dated this 6th day of February 2004, per authority granted by Sections
1.4.9(E) and 2.1 of the Land Use Code.

FACTS AND FINDINGS
1. Site Context/Background Information
The surrounding zoning and land uses are as follows:
N: CC — Existing neighborhood comprising mainly of multi -family housing,
fraternities, and sororities,
NE: CC — Existing Church, existing residential four-plex, existing group home
at the southwest corner of W. Plum and Shields,
E: CSU (not zoned) — Colorado State University main campus,
S: CC — Existing Commercial businesses abutting Shields Street and West
Elizabeth Street, Existing Church,
W: CC — Existing neighborhood comprising mainly of multi -family housing,
and single family detached housing.
The property is west of Shields Street, east of Scott Street, south of W. Plum
Street, and was annexed into the City as part of the Twelfth South Shields Street
Annexation in July of 1965.
2. Compliance with Article 4 and the CC -Community Commercial Zoning
District Standards:
Multi -family dwellings, mixed -use dwellings, retail establishments and offices are
permitted in the CC — Community Commercial Zoning District, subject to
administrative review.
This proposal complies with the secondary use restrictions of the CC District as
the proposed mix of multi -family and mixed use units, retail establishments and
offices is supportive of , and contributes to, the mixture of uses within the campus
area.
In addition, all applicable development standards of Article 4 have been met.
There was no evidence provided to otherwise refute compliance with this section.
3. Compliance with Article 3 of the Land Use Code — General Development
Standards
The Staff Report indicates that the Planning and Zoning Board granted a
modification to the off-street parking requirements on October 16, 2003.

STAFF RECOMMENDATION: Approval
NOTICE OF PUBLIC HEARING: Evidence presented to the Hearing Officer established
no controversy or facts to refute that the hearing was
properly posted, legal notices mailed and notice
published.
PUBLIC HEARING
The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the
hearing at approximately 3:00 p.m. on February 3, 2004 in Conference Room A at 281
N. College Avenue, Fort Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE:
The Hearing Officer accepted during the hearing the following evidence: (1) Planning
Department Staff Report; (2) application, plans, maps and other supporting documents
submitted by the applicant and the applicant's representatives to the City of Fort Collins;
and (3) a tape recording of the hearing. The LUC, the City's Comprehensive Plan (City
Plan), and the formally promulgated policies of the City are all considered part of the
evidence considered by the Hearing Officer.

This is a request to construct 17 additional dwelling units and 1,900 square feet of non-
residential space to the existing Cambridge House Apartments. The project includes
two separate buildings. The existing pool house will be converted to 5 two -bedroom
units. Additionally, a new 5-story building will be constructed on the east edge of the
property, abutting South Shields Street, with ground floor non-residential space and 12
three -bedroom apartment units on the second through fifth stories.
