HomeMy WebLinkAboutINTERSTATE LAND - ODP - 49-02A - CORRESPONDENCE - CITIZEN COMMUNICATIONWe the undersigned, all members of the Cooperslew Open Space Association, most strongly oppose the extension or "connectivity" of ANY of the streets in the Boxelder Estates through our private land into or with the proposed development to the East for the following reasons: a) The land was purchased specifically to prevent the extension or connection of the roads in Boxelder Estates to any developer to the East. b) As private land the liability issues rests with the owners. We, as owners, will not accept any additional risk. c) There are no "Health, Welfare or Safety" issues involved warranting an extension or connectivity of these roads. d) Originally and currently we opposed any event increasing traffic in our privately owned roads in Boxelder. Costs to us to maintain and repair obviously increases as traffic of any kind enlarges. I have lived at 3430 Surrey Lane since 1975. We thank you for the opportunity to be here and participate in a public hearing on the proposed Master Plan adjoining our Open Space and Boxelder Estates. We don't intend to keep you here till 1:00 or 2:00 in the mornin$even if we could! I'm here on behalf of the 20 residences in Boxelder Estates who own a strip of land that lies between Boxelder Estates and the land in the Master Plan. We're known as the Cooperslew Open Space Association. I will be followed by the Vice President of the Cooperslew Open Space Association and then 2 members of the Boxelder Homeowners Association. We anticipated that you might prefer access across this strip of land to connect Boxelder Estates streets to the land in the Master Plan. We are solidly opposed to any type access. We purchased this land in 1993 for the sole purpose of preventing any extension of our streets in Boxelder Estates. Our opposition is as strong as ever for the following reasons: The character of our neighborhood would change dramatically. There are 44 homes in the Boxelder Homeowners Association. We know every resident and are a tight knit neighborhood. Any kind of through access would alter this situation. 2. Safety issue. This one egress/ingress provides a certain safety factor which we do not want to lose. 3. Liability issue. Access across our open space land would put us at a greater risk liability wise. 4. The water table in the open space varies through the year, some areas being identified as wetlands. Also, there are the environmental issues with roads and potential endangered species in this space. 5. Maintenance. The owners are responsible for the maintenance of this area. Our costs and supervision responsibilities could increase dramatically. 6. There are no health, safety and welfare issues involved that would make access necessary. In closing, I emphasize that emotions run deep on this issue. We are before you in a united, powerful, peaceful manner to let you know we do not want any type access across our open space. We hope you listen and honor our request. If future protests are necessary, I doubt they will be as orderly as we planned this one. You don't deserve that and we do not want to be in that position.
