Dear Mr. Smith: I
Thank you very much for sending me the fax regarding the proposed storm water
control wall on our property. You may advise the City of Fort Collins that my wife and I are
inclined to negotiate an easement that would permit the erection of this wall. At the present, th
only conditions would be that my legal fats and expenses related to negotiating the easement in;
such a way that I am able to ensure that my future development rights are not negatively
impacted would be paid for. We expect the negotiations would be limited to making
determination that the zoning requirements, the size of the easement and obtaining commitments
from the City relative to future development rights will not be impacted by the casement, and 11C
actual negotiations of the terms themselves.
If this commitment by us appears to be in line with your expectations, please cal�
me so that we can comment work towards a mutually satisfactory solution. ,

Re: CSU South Dormitory Site Plan Advisory Review #50-02A
Dear Mr. Barkeen:
In connection with the proposed new dorm project, the City has requested a letter
of intent with respect to easements and rights of way. Based upon the Staff Project
Review dated February 26, 2003, and the discussions that have taken place between City
staff, Greg Smith and the University's consultants, we understand that the easements
listed below are necessary, and the University intends to grant them to the City:
1. An additional 18.5 feet right of way on Shields street, added to the existing
37-foot right of way for a total of 57.50 feet from the centerline.
2. An additional 5.5 feet right of way on James Court, added to the existing 20-
foot right of way for a total of 25.5 feet from the centerline.
3. A 9-foot utility easement on James Court. This easement will be in the
proposed detention area and they will share common ground. We propose
that that this 9-foot utility easement be connected to the existing 10-foot
existing utility easement on the south boundary of Lots 1-4 of Campus
Gardens Addition.
4. A temporary construction easement for replacement of the existing 8-inch
sanitary sewer line with a 10-inch line from James Court to Lake Street.
5. A utility easement for municipal water line, hydrants and curb stop in the
approximate location as indicated on the drawings.
