Included below are the comments received from City Staff from the first round review of
Modification of Standard for the Cooper Slough Buffer on the Interstate Land property. An
explanation of how issues have been addressed follows each comment. These comments
were initially received on January 9, 2003.

Per several meetings with City Planning Staff and Department of Natural Resources staff,
the modification request has been revised. The proposed buffer has been revised to reflect
a distance averaging 254' from the agreed upon edge of Cooper Slough. Please see the
attached plan, modification request and letter from Wildlands Consultants' Inc.
The applicant continues to maintain that a 300' buffer adjacent to this section of Cooper
Slough is excessive due to the lack of flowing water, standing water, wildlife habitat and
ecological diversity. The applicant agrees that the warm waters of Cooper Slough may have
once traveled within this area, but due development, the slough is merely a remnant of its
former condition. The applicant is proposing a buffer that is greater than 80% of the
minimum allowed but less than the required 300'.
