Statute text When the commission has adopted the master plan of the municipality or of one or more major sections or districts thereof, no street, square, park or other public way, ground or open space, public building or structure, or publicly or privately owned public utility shall be constructed or authorized in the municipality or in such planned section and district until the location, character, and extent thereof has been submitted for approval by the commission. In case of disapproval, the commission shall communicate its reasons to the municipality's governing body, which has the power to overrule such disapproval by a recorded vote of not less than two-thirds of its entire membership. If the public way, ground space, building, structure, or utility is one the authorization or financing of which does not, under the law or charter provisions governing the same, fall within the province of the municipal governing body, the submission to the commission shall be by the governmental body having jurisdiction, and the planning commission's disapproval may be overruled by said governmental body by a vote of not less than two-thirds of its membership. The failure of the commission to act within sixty days from and after the date of official submission to it shall be deemed approval. There is nothing in § 31-23-206 and this section which indicates a legislative intent to broaden a city's authority. They place ultimate governmental authority in matters pertaining to land use in unincorporated areas in the county. In effect, a city is given only an advisory role. Robinson v. City of Boulder, 190 Colo. 357, 547 P.2d 228 (1976). Amendment to plan not subject to referendum powers. Being advisory only, an amendment to a municipal master plan is not legislation which is subject to the referendum powers reserved to the people. Margolis v. District Court, 638 P.2d 297 (Colo. 1981). ' 8.6.3.B.9 Loading Zones The delivery service area and trash areas are designed to be located away from the front entrance and the main traffic circulation. 8.7 Signs One identification sign is proposed for the northeast corner of the lot. The size, height and materials will match the signage already in place for the Detention Center and the Sheriff's Administration Building. 8.9.2 Site Lighting The proposed exterior lighting plan was designed to meet the security needs of the project. The poles are located along drives and in the parking lot. The light poles will be 25 feet tall, with shoe box -type fixtures. High-pressure sodium lamps will be used; with cut-off reflectors to minimize glare. The style of poles and fixtures are consistent with the surrounding campus. The proposed plan meets the minimum foot-candle requirements for non-residential areas. 4 to visually anchor the building to the site. Deciduous canopy trees are used to provide shade in the parking areas and service areas are screened from public view. Larimer County will be maintaining the landscape. The landscape design adheres to xeriscape principles in several ways including selection of low water use plants, utilizing soil amendments and mulch materials, and zoning the irrigation system appropriately. In addition, Larimer County is committed to monitoring the irrigation system to avoid over watering. Water and sanitary sewer is to be provided by the City of Fort Collins. Review Criteria 8.6 Off -Road Parking Standards 8.6.3 B.2. Spaces Required Because of the nature of the facility, it is difficult to determine the parking space requirements per Table 8.6.3(B). 2.1. Parking ratios have been calculated based on existing and projected Community Corrections needs. Nearly all of the residents do not own cars and will use alternative forms of transportation. Employees, visitors, and the day reporting center clients mainly will use the parking spaces. There will be a total of 33 employees at the facility. 18 employees will be present from 7:00 AM to 6:30 PM. Since the facility operates 24-hours a day, the remaining 15 staff will be on -site at intervals throughout the afternoon and night. The typical visiting hours are between 7:00 PM and 10:00 PM Monday through Friday, with approximately 6 to 10 visitors. Weekend visiting hours are 10:00 AM to 9:00 PM with 20 people on site. Visiting hours occur during off hours, so the parking lot will be fairly vacant. There are a total of 50 parking spaces on the site, with 3 handicapped spaces provided. 8.6.3.B.5. Setbacks The parking lot meets the minimum setbacks from the private street (10 feet) and the west property line (30 feet) 8.6.3.B.7. Bicycle Facilities The number of bicycle parking spaces exceeds the minimum, with 60 resident/visitor bikes and 5 employee bikes. All bicycle facilities are located close to the building entrances. Additionally, employee bike parking will be located in secure bike locker enclosures, located near the service entrance. 3 equipment is located to be screened completely from view by either enclosures or extended parapet walls. The lot is accessed from a 28-foot wide private drive from Midpoint Drive. The drive will align with Specht Point Drive and will continue along the southeast side of the property. There will be two driveway cuts entering the parking lot. It is necessary to have two separate entrances to the building in order to separate resident and non-resident traffic. The day reporting/non-resident parking area will contain 13 parking spaces and 4 parallel van spaces. The day reporting entrance is located on the northeast side of the building. There is a six-foot wide sidewalk that serves this entrance, extending from the parking to Midpoint Drive, affording easy access to pedestrian and bicyclists coming from other destinations. The main entrance to the building is located on the southwest side. Parking for 33 cars is available for employees and visitors. It is anticipated that the Community Corrections residents will not have access to cars. Therefore, a large bicycle parking area for 60+ bikes will be provided. Since many of the residents bike to jobs or other destinations, another six-foot wide sidewalk is provided from the bike area to the sidewalk along Midpoint Drive. Although there is no bus service to this area presently, it is anticipated that the potential for bus ridership is high and that future service may eventually be reinstated. A trash/recycling enclosure is located at the northwest corner of the parking lot. Service and deliveries are accommodated along the curved end of the parking area, close to the service entrance. Food will be prepared at the Detention Center and delivered in bulk containers to the Community Corrections building. In addition, a half -court basketball court will be available for the recreational use of the residents. The facility is operated 24-hours a day, seven days a week. However, the business operations have been modified in order to reduce the number of cars accessing the site during peak business hours. This subject is outlined in detail in the Transportation Impact Study. The landscape design for the facility responds to the needs of the facility users, enhances the building architecture and emphasizes xeriscape principles. The proposed Corrections Facility is part of the detention center campus and therefore security is an important issue. In order to minimize the opportunity for anyone to hide behind trees or shrubs, and to minimize shadow areas at night, we have avoided using evergreen trees and shrubbery taller than two feet. Despite these constraints, the landscape plan provides an attractive setting for the building with a variety of plant material to provide seasonal interest. Street trees are provided along Midpoint Drive consistent with City landscape guidelines and deciduous and evergreen foundation plantings are used around the building 2 '`yfy�j�1pli�,IASeOCIATES INC Landscape Architecture Urban Design Planning May 19, 2003 Larimer County Community Corrections Facility Site Plan Review Project Description and Review Criteria Project Description The Larimer County Community Corrections Facility will be located on approximately 2.84 acres at the southwest corner of Midpoint Drive and Specht Point Drive. The site is on the west side of the existing Detention Center. The remaining land adjacent to the property is undeveloped, however, approved PLID's exist west and north of the site. In addition, the former American Eagle Distribution warehouse is located near the southwest end of the property. The land is zoned E-Employment and is located within the City limits. The proposal is for a new Community Corrections Facility to house 176 residents. The new facility will replace the existing Halfway House located on West Laurel Street. The building will contain 32,400 sq. ft. and will include offices, visitation rooms, kitchen/dining areas, classrooms, resident's bedrooms, day rooms and laundry facilities. The main part of building will be a combination of one and two -stories, with the residential wing consisting of three stories. The design of the building is meant to harmonize with the existing campus architecture, but express a less institutional identity consistent with the more residential aspect of the facilities' purpose. On the exterior, decorative masonry veneer will be blended with stucco (EIFS) accents. Window locations are tinted high performance glass set in anodized aluminum frames. Single -story areas will be softened with the use of sloped standing seam metal roofing at entry locations. The three-story portion will have sloped berms at the base of the building to visually reduce the height of the structure. Other areas of the building will utilize a decorative masonry base treatment to unify the look of the building on all elevations. Exterior patio areas for residents are screened with decorative masonry walls to allow privacy and to control views from Midpoint Drive into the facility.
