HomeMy WebLinkAboutTIMBERLINE VILLAGE - HARMONY SCHOOL SHOPS, 4TH FILING - PDP - 10-03 - REPORTS - MEMO / P & Z BOARDCity of Fort Collins Comm. .y Planning and Environmental _rvices Current Planning MEMORANDUM TO: Planning and Zoning Board FROM: Ted Shepard, Chief Planner 11, DATE: August 20, 2003 RE: Timberline Village P.D.P. — Condition of Approval The P.D.P. calls for an eight -foot wide asphalt sidewalk connecting the entrances to Buildings One and Two across vacant land to the entrance of the Harmony Mobile Home Park. This walk is considered temporary, as it would someday be replaced by a permanent sidewalk when the property is developed. The applicant, Miller -Weingarten, is actively pursuing a letter of intent and easement for construction of this walk with the owner of the park, ARC. At this particular time, however, obtaining this easement is proving difficult. ARC is undergoing a major refinancing and restructuring due to converting the company into a component of a real estate investment trust and the proper documentation has not yet been produced. In order to emphasize the need for this easement to be produced in a timely fashion, Staff is recommending the following condition of approval: Approval of the Timberline Village Community Shopping Center P.D.P. is conditioned upon the submittal of an Easement to be granted to the applicant, Miller -Weingarten by the owner of the Harmony Mobile Home Park for the purpose of an eight -foot wide asphalt sidewalk. This easement shall be submitted to the City, reviewed, and found acceptable prior to Final Compliance of the P.D.P. Miller -Weingarten shall make every reasonable attempt to secure this easement. In the event that the grantor refuses to grant this easement, then Miller - Weingarten shall construct an eight -foot wide temporary asphalt walk within the existing Harmony Road right-of-way as an alternate design. This walk shall be constructed beginning at the southeast corner of the P.D.P., and then east to the back of the curb abutting the driveway at the intersection of Harmony Road and the Harmony Mobile Home Park entrance drive. 281 North College Avenue - P.O.
