Re: Fax sent regarding Bank of Colorado project
Jon, I wanted to respond to your fax and telephone message to me regarding the Bank, of
Colorado and the item you feel would be appropriate for the City to require of this
development as a condition of approval. For documentation purposes I will paraphrase
your desire. As I understand your request, you are asking the City to require the Bank of
Colorado to share their enter way off of Lemay Avenue with a future development
project to the north. In addition, you would like. the City to require the bank project to
dedicate the drive entry as public right-of-way in the future. The intent of this right-of-
way would be to provide street access to the north for future development. Unless, I am
mistaken I believed this is what you proposed to us and the bank some months ago. In
fact the City was under the impression that the bank and yourself were in agreement with
this concept. Evidently, issues have arisen that we are not aware of, consequently, you
are trying to put us in the middle of a civil dispute.
Unfortunately, the City can not do as you have requested. Since there is not an
application in our system for this northern project, showing the intent, density, layout or
design we will not require a shared drive or dedication of right-of-way. The City does
not have legal standing to accommodate your request. This item of discussion is better
suited as discussions between the owners of the north property and the bank. I suggest
working and cooperating with the bank will accomplish both your needs and theirs. If
you wish to pursue your desires with the bank project, it should be done quickly. They
are in the Final Compliance stage of the City's process and will soon have approval to
proceed with construction of their facility.
