McMurry. Their response letter states that the revised site plan shows the building
envelope dimensions. However I don't see them.

REPEAT COMMENT: The way the drive -up is configured, I don't see how the stacking
can accommodate more than 1 vehicle for 3 drive -up "windows". I don't believe that's
acceptable. Original comment: In the event that a determination is made that 3
drive -up lanes does not violate the definition of "convenience shopping center", there
does not appear to be adequate room for stacking of vehicles.
There are several significant comments that must be addressed prior to this item
going to a Planning and Zoning Board public hearing. Another round of review may be
necessary; however, it is possible that this item could be scheduled for either a July
171h or August 71h public hearing if the main issues can be resolved auickly. If another
round of review is going to be done then the proposal is subject to the 90-day
revision re -submittal requirement (from the date of this comment letter, being
June 18, 2003) as set forth in Section 2.2.11(A) of the Land Use Code. Be sure
and return all of Your red -lined plans when you re submit The number of copies of
each document to re -submit is shown on the attached Revisions Routing Sheet.

Provide a swale cross section for the minor Swale that would drain the minor flows
from the building frontage along Harmony. Why is a grated inlet at the manhole not
possible to drain flows from that swale into the pipe rather then allowing flows to go
over the pipe outlet into the swale?
Good job on addressing most of my comments. This item is ready for hearing from my
perspective.

(6/11] Please remove any indication of right-of-way (14.12') being dedicated on
Harmony Road. After further internal discussion, it was decided not to require the
additional right-of-way dedication along Harmony Road due to the current right-of-way
being able to accommodate the future edge of pavement and the 80' setback
incorporating sidewalk and landscaping. By not requiring the right-of-way dedication,
issues regarding CDOT approvals are no longer needed.

It doesn't appear that the ultimate design of Harmony Road (three through lanes) was
accommodated into the site design. Please use the information provided on the
"Harmony Road - Lemay Avenue to I-25 Horizontal Alignment" (C1-237) to
accommodate for the future widening, providing right-of-way dedication and
establishing setbacks from future edge of pavement. Additional right-of-way may be
needed and the location of the building may need to be changed to ensure the 80'
setback along the Harmony corridor.

The bank drive-thru area at the east end of the building, as shown on the Landscape
Plan, is a vehicular use area that requires a 5' landscaped setback from the lot line.
This is set forth in Section 3.2.2(J) of the LUC. Please see the copy of the red -lined

The proposed building is proposed to be in excess of 40' in height. The Shadow
Analysis Plan that was submitted for review, in accordance with Section 3.5.1(G) of the
LUC, would indicate that the building will not have a substantial adverse impact on
adjacent properties. However, the information needed to satisfy Sections
3.5.1(G)(1)(b)2 - a visual analysis and 3.5.1(G)(1)(b)3 - a summary of the key conclusions
of the shadow and visual analysis were not submitted. Please provide this information
to me as soon as possible.
