prior to formal submittal of the request (Section 2.2.2 of the LUC).

9. This development request will be subject to the Development Review
Fee Schedule that is available in the Current Planning Department
office. The fees are due at the time of submittal of the required
documents for the Project Development Plan and Final Compliance
phases of development review by City staff and affected outside
reviewing agencies.
10. This development proposal is subject to the requirements as set forth
in the City's LUC, specifically Articles 2. Administration (Development
Review Procedures), Article 3. General Development Standards, and
Article 4.21 - Harmony Corridor District. Please be aware that a
convenience shopping center is defined as a "secondary" use in this
District, subject the restrictions set forth in Section 4.21(D)(2) of
the LUC.
C. The trash enclosures must be designed to conform to the
primary buildings materials and colors, to accommodate
recycling, and must be properly screened from view.

7. Tom Reiff of the Transportation Planning Department offered the
following comments:
a. A TIS, addressing all modes of transportation, will be required
with your PDP submittal. Please contact Eric Bracke of the
Traffic Operations Department (224-6062) and Tom Reiff of
the Transportation Planning Department (416-2040) to
determine what information may be needed in the TIS
pertaining to LOS for vehicle, pedestrian, bicycle, and transit
modes of transportation.
b. This site is in an enhanced travel corridor for East Harmony
Road.
C. Please contact GayLene Rossiter of Transfort for information
on existing and proposed transit stops in this area and how they
could possibly affect this proposed development.
d. Southbound left turns onto East Harmony Road from McMurry
Avenue need to be evaluated.
e. The LUC sets forth the required amount of bicycle and
handicapped parking for this proposed development. Please see
Sections 3.2.2(C)(4) & (K)(5) of the LUC.
f. Cross -access to the undeveloped property to the east may need
to be provided, at least in the form of pedestrian access.

d. This site drains into the Golden Meadows detention pond. It
was designed under the old rainfall criteria. This must be
evaluated under the new rainfall criteria and additional
detention capacity may be needed.

5. Doug Martine of the Light & Power Department offered the following
comments:
a. Power is available at the southwest corner of this site.
b. A C-1 Commercial Form must be filled out to help determine the
electric needs for this redevelopment.
C. The normal charges, both development and system charges, will
apply to this request.
d. Please coordinate the transformer location(s) with Light &
Power. They can be no more than 10' from a paved surface
accessible by a City line truck and must be at least 4' from any
building.

6. Tara Williams of the Natural Resources Department offered the
following comments:
a. A Fugitive Dust Control Permit will be necessary. This permit
would be issued by the Larimer County Environmental Health
Department. Please contact them directly for information
about their requirements.
b. Native plant materials and grasses should be incorporated in
the Landscape Plan. The use of bluegrass should be minimized.

!`d..\ Any existing water or sanitary sewer services extending onto
this site must be used (if properly sized) or abandoned at the
main.
e. y Coordinate landscaping and earth berms with regard to
required separation distances from the existing water mains
crossing this site.
f. The City's water conservation standards for landscaping and
irrigation systems will apply to this site. Information on these
standards can be obtained at the Water Department and the
Current Planning Department.
g. Plant investment development fees and water rights will apply
to this development and they will be due at time of issuance of
building permits.

4. Glen Schlueter of the Stormwater Utility offered the following
comments:
a. The site is located in the Fox Meadows Drainage Basin, where
the development fee is $6,468 per acre, which is subject to the
runoff coefficient reduction.
b. The standard drainage and erosion control report and
construction plans are required and they must be prepared by a
professional engineer registered- in the State of Colorado.
c. On -site water quality extended detention to treat the runoff is
required with this development.

i This project will need to dedicate additional street right -of-
/ way (ROW) for McMurry Avenue so that the required sidewalk
will be in the ROW. Also, a utility easement would then need to
be granted behind the ROW.
e. This property may be responsible for the design of
improvements to East Harmony Road and McMurry Avenue along
its frontages. The design must be to current City standards.
f. This property may be responsible for a repay for McMurry
Avenue. Please contact Dean Klingner (221-6605) or John Lang
(221-6583) of Engineering for information regarding a potential
repay.
g. The Larimer County Road Impact Fees will apply to this
redevelopment.
h. The proposed access from McMurry Avenue may work;
however, the City would prefer that this developer work with
the property owner to the north to provide a shared access.
A Development Agreement and a Development Construction
Permit will be needed for this development.

3. Roger Buffington of the Water/Wastewater Department offered
the following comments:
a. There is an existing 8" water main in McMurry Avenue; and,
existing 8" and 36" water mains that cross the south portion of
the site in an east - west alignment.
b. There is an existing 8" sanitary sewer main at the northwest
corner of this site.
C. Maintain existing water main easements on this site.
b. This development request would be subject to the maximum
allowable parking for the proposed non-residential uses as set
forth in Section.3.2.2(K)(2) of the LUC. -1, ,00r
C. This development request would be subject to the building
placement requirements as set forth in Section 3.5.3(B) of the
LUC.

d. This property is not in the City's Residential Neighborhood
Sign District.

2. Marc Virata of the Engineering Department offered the following
comments;
a. The standard utility plan submittal requirements will apply to
this development request.
b. Street oversizing fees will apply to this development request.
The fees are based on vehicle trip generation for the proposed
land uses in the development plan. Please contact Matt Baker of
Engineering (224-6108) for detailed information on the fees.
The fees will be collected at the time of issuance of building
permits.
C. A Transportation Impact Study (TIS), addressing all modes of
transportation, will be required with your Project Development
Plan (PDP) submittal. Please contact Eric Bracke of the Traffic
Operations Department (224-6062) and Tom Reiff of the
Transportation Planning Department (416-2040) to determine
what information may be needed in the TIS pertaining to Level
of Service (LOS) for vehicle, pedestrian, bicycle, and transit

LAND USE DATA:
Request for approximately 21,000 square feet of commercial/retail uses,
possibly designed to function as a convenience shopping center, on Lots 4 & 5
of the Golden Meadows Business Park. The property is located at the
northeast corner of East Harmony Road and McMurry Avenue. The property
is in the HC - Harmony Corridor Zoning District.
COMMENTS:
1. Gary Lopez of the Zoning Department stated that the property is in
the HC - Harmony Corridor Zoning District in the Land Use Code
LUC . He offered the following comments:
a. The proposed commercial/retail land uses, to function as a
convenience shopping center, would be permitted in the HC
i� District, subject to a Planning and Zoning Board (Type II)
review. Please be aware that general retail is not permitted in
the HC District other than in a convenience shopping center.

For your information, attached is a copy of the Staff's comments concerning the
request for Commercial/Retail Uses on Lots 4 & 5 of the Golden Meadows
Business Park at the Northeast Corner of East Harmony Road & McMurry
Avenue, which was presented before the Conceptual Review Team on August 26,
2002.
This is a request for approximately 21,000 square feet of commercial/retail uses,
possibly designed to function as a convenience shopping center, on Lots 4 & 5 of the
Golden Meadows Business Park. The property is located at the northeast corner of
East Harmony Road and McMurry Avenue. The property is in the HC - Harmony
Corridor Zoning District.
The comments are offered informally by Staff to assist you in preparing the
detailed components of the project application. Modifications and additions to
these comments may be made at the time of formal review of this project.
